NOTICE is hereby given that on July 22, 2021 and amended on August 19, 2021, Bill Bruce King, P.O Box 2670, Moriarty, NM 87035 and Entranosa Water and Wastewater Association (Entranosa), Jack Crider, CEO, 1330 State Highway 333, Tijeras, NM, 87059, filed Application No. (E-2298-A, E-4854-C ENLGD, E-6722 & E-6722-S, E-2298 thru E-2298-S-30, E-4854-A, E-4854-B, and E-4854-E)-Commingle (4) with the STATE ENGINEER for Permit to Change the Purpose of Use and the Place of Use of Ground Water within the Estancia Underground Water Basin within the State of New Mexico. Bernalillo County, Sandoval County, Santa Fe County, and Torrance County are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This Notice is ordered to be published in the Albuquerque Journal (Bernalillo, Sandoval, and Torrance Counties) and The Santa Fe New Mexican (Santa Fe County). In general, under this application, the co-applicants are proposing to transfer Bill Bruce King's 710.50 acre-feet per annum (afa) Farm Delivery Requirement of groundwater, inclusive of a Consumptive Use amount of 363.776 afa, Licensed under File No. E-150, and associated with Well Nos. E-150, E-150-S, E-150-S2, E-150-S3 and E-150-S4 into Entranosa's permit. Entranosa will connect to the aforementioned five (5) wells through an easement provided by Bill Bruce King and a series of transmission lines which will connect to Entranosa's existing system. Further, booster stations will pump the requested diversion of water into Entranosa's distribution network serving members within the service area of Entranosa. The co-applicants propose to discontinue from five (5) wells, the diversion of 710.50 afa Farm Delivery Requirement of groundwater, inclusive of a Consumptive Use amount of 363.776 afa, Licensed under File No. E-150, owned by Bill Bruce King. Said five (5) wells are, Well E-150, located at a point described as where X=403,579 meters and Y=3,884,397 meters intersect, UTM Zone 13 North, NAD 83, further described as located within the NENWNE of Section 14, Well E-150-S, located at a point described as where X=403,579 meters and Y=3,884,197 meters intersect, UTM Zone 13 North, NAD 83, further described as located within the SWNWNE of Section 14, Well E-150-S2, located at a point described as where X=404,081 meters and Y=3,884,294 meters intersect, UTM Zone 13 North, NAD 83, further described as located within the NENE of Section 14, Well E-150-S3, located at a point described as where X=404,081 meters and Y=3,884,294 meters intersect, UTM Zone 13 North, NAD 83, further described as located within NENE of Section 14, and Well E-150-S4, located at a point described as where X=403,670 meters and Y=3,883,902 meters intersect, UTM Zone 13 North, NAD 83, further described as located within SWSE of Section 14, all located within Township 10 North, Range 8 East, NMPM, for domestic and irrigation purposes on 284.20 acres of land owned by Bill Bruce King, located within the Part of the E of Section 14, Township 10 North, Range 8 East, NMPM, Santa Fe County, New Mexico. The above-described move-from land is located along the west side of Valley Irrigation Rd., South of Boomer Road and North of Dinkle Road, Moriarty, Santa Fe County, New Mexico. The co-applicants further propose to divert from the same five (5) aforementioned wells the above-described water rights for domestic, irrigation, industrial, commercial, housing, subdivision and related purposes within the permitted service area of Entranosa, owned by various owners and located within portions of Bernalillo County, Sandoval County, Santa Fe County, and Torrance County, to serve the growing population within the East Mountains. For the full legal description of this move-to place of use, please see the application. The application states that no increase in the Consumptive Use amount under License No. E-150 is requested. The E-150 Wells will be connected to Entranosa's existing water distribution system through an easement and series of transmission lines. Co-applicant Bill Bruce King will provide an easement for a 5,000-foot, 8-inch transmission which will connect the E-150 Wells to Entranosa's existing system at Boomer Road by Irby Road. The existing system connects three existing wells to a transmission line on Highway 472, which in turn connects two additional wells before continuing west to Highway 344, then enters into booster stations at Front Road and Nugent Road. The booster stations pump into the distribution network serving members of Entranosa. Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). ). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109, on or before November 5, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
