NOTICE OF PENDENCY OF ACTION STATE OF NEW MEXICO to Group I and Group II Defendants that may have an interest in the premises adverse to the Plaintiff, GREETINGS: You are hereby notified that BCS, LLC, a New Mexico Limited Liability Company has filed a civil action in the District Court of Torrance County, New Mexico, Cause No. D-722-DV2021-00107, and wherein Plaintiff seeks to obtain constructive service of process upon you. The general object of the action is to establish and quiet title of Plaintiff, as a good, sure, perfect, and indefeasible estate in fee simple against the adverse claims of you, and each of you in and to the following real estate, situate in Torrance County, New Mexico, which property is more particularly described as follows: Lot 33, Block 2 of that New Mexico real estate development known as "SUNSET ACRES", as described in the Plat Map for Sunset Acres Subdivision, filed in Torrance County, New Mexico and described as: South one-half (S ) of Section Three , Township Nine (9) North Range Eight (8) East, in Torrance County , New Mexico, containing 320 acres, more or less. (hereinafter referred to as "Lot 33") Street address: 28 Jemez St., Moriarty, New Mexico, 87035 and Lot 8, Block 4 of that New Mexico real estate development known as "SUNSET ACRES", as described in the Plat Map for Sunset Acres Subdivision, filed in Torrance County, New Mexico and described as: South one-half (S ) of Section Three , Township Nine (9) North Range Eight (8) East, in Torrance County , New Mexico, containing 320 acres, more or less. (hereinafter referred to as "Lot 8) Street address: 29 Jemez St., Moriarty, New Mexico, 87035 It is further the object of said suit to bar and estop you, and each of you, from having or claiming any lien upon or any right to the said premises adverse to Plaintiff. You are further notified that unless you enter your appearance in said cause on or before September 18, 2021, judgment by default will be entered against you and the relief prayed for in the Complaint to Quiet Title will be granted.
