NOTICE OF SALE NOTICE IS HEREBY GIVEN that pursuant to the Default Judgment entered on March 10, 2021 (the "Judgment"), the undersigned Special Master will sell at the public auction, for cash or certified funds, at the hour of 11:00 a.m., on April 27, 2021, at the main entrance of the Sandoval County Judicial Complex, 1500 Idalia Rd., Bldg A, Bernalillo, New Mexico, the real property situated in Sandoval County, New Mexico described as follows: Lot numbered 8, in block numbred 1 Budgagher Estates, as shown and designated in plat entiled "Budagher Estates Section 8, T 14 N, R 6 E Sandoval County, New Mexico, filed in the Office of the County Clerk, Sandoval County, New Mexico, On July 1, 1983 Recorded in Vol.3, Folio 418A." (the "Property"). The Property will be sold subject to rights of redemption; easements, reservations and restrictions of record; taxes and governmental assessments; any liens or encumbrances not foreclosed in the proceeding; the valuation of the property by the County Assessor of real and personal property; affixture of any mobile or manufactured home to the land; deactivation of title to mobile or manufactured home on the property; environmental contamination, if any; any association or condominium dues, assessments, declarations, rules, requirements and restrictions; any requirements imposed by city or county ordinance or by state law affecting the property; and zoning violations concerning the property, if any. No representation is made as to the validity of the rights of ingress and egress. Transfer of title to the highest bidder shall be without warranty or representation of any kind. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING. This action is a suit to foreclose liens secured by the real property described above. The amount awarded by the Judgment to the Plaintiff, as set forth in the Judgment Lien, is $47,316.58, plus costs and attorney fees of $7,047, plus interest accruing after January 12, 2021 at the rate of 9.0% per annum. The proceeds from the judicial sale will be applied first to the payment of the costs and expenses of the sale; then to the payment of the Judgments stated above. Any excess funds shall be deposited with the Clerk of Court for distribution by further order of the Court. The plaintiff may apply all or a portion of his Judgment towards the purchase price. Otherwise, terms of sale shall be immediately payable cash or certified funds. This notice shall be published once a week, for four consecutive weeks, in the Albuquerque Journal, with the last publication taking place at least three days before the date of sale, as provided by Section 14-11-10 N.M.S.A.
