NOTICE OF SALE ON FORECLOSURE STATE OF NEW MEXICO COUNTY OF BERNALILLO SECOND JUDICIAL DISTRICT COURT THE BANK OF NEW YORK MELLON, AS TRUSTEE FOR CIT MORTGAGE LOAN TRUST 2007-1, Plaintiff, No. D-202-CV-2015-02069 v. CYNTHIA PARRA, A MARRIED WOMAN AS HER SOLE AND SEPARATE PROPERTY; ELIJAH A. CHASE; JANE DOE CHASE; THE VENTANA RANCH COMMUNITY ASSOCIATION, INC.; SANDIA AREA CREDIT UNION; STATE OF NEW MEXICO TAXATION AND REVENUE DEPARTMENT, Defendants. PLEASE TAKE NOTICE that the above-entitled Court has appointed me Special Master in this matter with the power to sell the following described property and improvements located in Bernalillo County, New Mexico described as follows: LOT NUMBERED NINETY-ONE (91) OF VISTA DE ARENAL SUBDIVISION AT VENTANA RANCH, (A REPLAT OF TRACT 24 VENTANA RANCH), ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON JULY 17, 2001, IN BOOK 2001C, PAGE 202. Together with all improvements, easements, appurtenances, and fixtures. This real property is located at 6800 Candelia Ave. NW, Albuquerque, New Mexico (the "Property"). The Stipulated and Default Judgment In Rem and Decree of Foreclosure (hereafter the "Judgment") was entered on January 10, 2020. The sale is to begin at 9:00 a.m. on June 19, 2020, at steps leading to the front entrance of the Second Judicial District Court Courthouse, 400 Lomas NW, Albuquerque, New Mexico 87102. The Property will be sold "AS IS" to the highest bidder for cash, free and clear of all liens of the parties hereto and all persons claiming under and through the parties or any persons claiming an interest by an instrument filed for record after March 20, 2015. Every bid made shall be deemed an irrevocable offer until the sale has been completed, and the sale is completed when confirmed by the Court. In the event the purchaser fails to pay the purchase price at sale, or make satisfactory arrangements with the Special Master for such payment, the Special Master may accept the next highest bid or proceed with the sale of the Property to the highest bidder. The Special Master or her representative may postpone or continue the sale by public declaration at the time and place originally scheduled for such sale. No other notice of the postponed or continued sale need be given. The purchaser of the Property will take it subject to rights of redemption, any unpaid property taxes, municipal charges, assessments, or liens not identified and foreclosed in this action. The Plaintiff or its assignee has the right to bid at the sale all of the Judgment amount or any portion thereof for credit. TRANSFER OF TITLE SHALL BE WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE PROPERTY AND TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING. The proceeds of the sale shall first be applied to pay the expenses of the sale, including special master's fee, then for any costs incurred for the maintenance and protection of the property, then to satisfy the in rem Judgment in favor of Plaintiff, The Bank of New York Mellon as Trustee for CIT Mortgage Loan Trust 2007-1, or its assign. As of December 12, 2019, the sum necessary to satisfy the Judgment is as follows: Principal $181,606.67 Accrued Interest $81,560.78 Advance Balance $?12,196.14 Escrow Advances $24,005.70 Total $299,369.29 Interest shall continue to accrue at the rate of 8.875% per annum ($43.54 per day) thereafter until the Property is sold. In addition, costs and expenses including, without limitation, reasonable attorneys' fees, disbursements and other property protection advances, and any additional costs of collection and suit (to include the cost of publication of this notice, recording fees, and special master fees) may be awarded by the Court and satisfied from the proceeds of the sale. Any additional proceeds remaining after the satisfaction of the above will be held in trust by the Special Master, paid into the Court Registry by the Special Master, or applied as determined by the Court.
