NOTICE OF PRELIMINARY ORDER OF ENTRY AND NOTICE OF CONDEMNATION TO: The above-named Defendants, You, and each of you, are hereby notified that the Court has granted to Petitioner Board of County Commissioners of Bernalillo County, a Preliminary Order of Entry to immediately enter and occupy the property described below and to do such work thereon as may be required, and that unless you file objections thereto within ten (10) days after personal service of this Notice upon you, or within three (3) days after the last date of publication of this Notice, if you be not personally service, the Court shall enter a Permanent Order of Entry, restraining you forever from hindering or interfering with the occupation and use of the property; and, further, that all proceedings subsequent to the Permanent Order of Entry shall deal only with the amount of compensation due to you for the taking of the property. You, and each of you, are hereby further notified that a Complaint for Condemnation to condemn property for public roadway purposes has been filed against you with the Clerk of the District Court of Bernalillo County, New Mexico, in which County the property, or part thereof, is located and which property is described in the Complaint for Condemnation filed herein. The property is described as the right-of-way frontage along Woodward Road SW near 2nd Street SW in Bernalillo County, New Mexico. The above property is more particularly described in the Complaint/Petition for Condemnation on file in this cause, and that such project has been designated as the right-of-way frontage along Woodward Road SW near 2nd Street SW, Bernalillo County, New Mexico. The legal description of the Property is: 2-2 A certain parcel of land located within the NW1/4 SW1/4 of Section 32; Township 10 North; Range 3 East; N.M.P.M., Bernalillo County, New Mexico, being a portion of Tract 90-A, as the same is shown and designated on the plats entitled "Summary Plat of Tract 90, Amended Map No.44, M.R.G.C.D." filed in the Office of the County Clerk of Bernalillo County, New Mexico on October 4, 1974, 1961 in Vol 1, Folio 44, and being a portion of the property described in Warranty Deed filed September 3, 2009 as Document #2009100694 in the Office of the County Clerk of Bernalillo County, said parcel being more particularly described by New Mexico State Plane Coordinate System grid bearings (NAD 83, Central Zone) and horizontal ground distances as follows: BEGINNING at the northwest corner of Parcel 2-2, Project No. A300161, a point conterminous with the intersection of the existing (2019) easterly right-of-way line of 2nd Street and the existing (2019) southerly line of Woodward Road, (Woodward Road Survey Centerline Station 0+47.90 offset 40.00 feet to the right, Woodward Road Construction Centerline Station 101+47.56 offset 39.22 feet to the right) WHENCE ACS monument SMW-3 bears S81?29'48"E a distance of 985.22 feet, Thence, S85?11'28"E a distance of 116.02 feet along the existing (2019) southerly right-of-way line of said Woodward Road also being the northerly line of the parcel herein described to the point of intersection of said southerly right-of-way-line and the easterly line of said Tract 90-A being the northeast corner of Parcel 2-2; Thence, S4 28' 03"E a distance of 10.73 feet leaving said existing (2019) southerly right-of-way line of Woodward Road, along the easterly line of said Tract 90-A being east line of the Parcel 2-2 to the southeast corner of Parcel 2-2; Thence, N85 16' 58"W a distance of 90.54 feet leaving said easterly line, along the southerly line of Parcel 2-2 to an angle point of Parcel 2-2.; Thence, S8 59' 10"W a distance of 97.51 feet along said southerly line to an angle point of Parcel 2-2; Thence, N85 15' 03"W a distance of 2.47 feet along said existing southerly line of Parcel 2-2 to a point on the existing (2019) easterly right-of-way line of 2nd Street, being the southwest corner of Parcel 2-2; Thence, N4 27' 59"W a distance of 109.42 feet along said existing (2019) easterly right-of-way line of 2nd Street also being the westerly line of the parcel herein described to the point and place of beginning. This withdrawal may be made only by Order of the Court upon proper Motion. You, and each of you, are hereby commanded to file and serve an answer, as provided by law, to the Complaint/Petition for Condemnation on file herein within thirty (3) days after service of this Notice on you or three (3) days after the last date of publication of this Notice, if you are not personally served.
