NOTICE is hereby given that on March 4, 2020, Dale A. Leach and Andrew W. Schollett, c/o Tim Oden, PO Box 1976, Moriarty, NM, 87035, filed with the STATE ENGINEER Application No. E-216-AC into E-890-S-3 for Permit to Change Point of Diversion and Change Place and Purpose of Use of Groundwater within the Estancia Underground Basin of the State of New Mexico. Torrance County is the county affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Albuquerque Journal. The applicants propose to discontinue the diversion of 38.2 acre-feet of groundwater per annum, from well E-216 located a point where X = 400,215 meters and Y = 3,843,302 meters, UTM (NAD83), in the NW SE SW of Section 22, Township 6 North, Range 8 East, NMPM, for the irrigation of 35.5 acres of land within Section 22, Township 6 North, Range 8 East, NMPM, consisting of 9.1 acres within a portion of the SE NW SE, 9.1 acres within a portion of the SW NW SE, 8.0 acres within a portion of the SE NE SW, 7.5 acres within a portion of the SW NE SW, 0.9 acres within a portion of the SE NW SE, and 0.9 acres within a portion of the SW NW SE, all owned by Dale A. Leach and Andrew W. Schollett. The move-from land is approximately 2.25 miles northwest of the intersection of State Highway 41 and Langley Rd, within Torrance County, New Mexico. The applicants further propose to transfer the above described water rights to well E-890-S-3 located a point where X = 402,860 meters and Y = 3,873,329 meters, UTM (NAD83), in the SE SW SW of Section 14, Township 9 North, Range 8 East, NMPM, on land owned by the City of Moriarty, for municipal purposes on 7.5 acres of land located within the NE NW SE of Section 24, Township 9 North, Range 8 East, NMPM, owned by Ranya Adell, LLC. The application states "Parcel B, Lands of Tate Family Trust was recently purchased by Ranya Adell, LLC, and annexed into the City of Moriarty. As part of the annexation agreement, Ranya Adell, LLC shall provide water rights of 17.2 AFA to the City of Moriarty for the development of this 7.5 acres. Ranya Adell, LLC has a purchase agreement with Dale A. Leach and Andrew W. Schollett for this 38.2 AFA (33.7 acres of irrigated grassland and 1.9 acres of irrigated cropland)." The move-to land is located on the southeast corner of Center Ave and Calle de los Ninos Ave, Moriarty, Torrance County, New Mexico. To view the application and supporting documentation contact the State Engineer District I Office to arrange a date and time for an appointment located at 5550 San Antonio Dr. NE, Albuquerque, NM 87109. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights*; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109, on or before May 29, 2020. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
