Notice is hereby given that on January 21, 2020, Village of Cimarron, C/O Shawn Jeffrey, P.O. Box 654, Cimarron, New Mexico 87714, filed application SD-00293-A into SD-02127 with the STATE ENGINEER for permit to Change Point of Diversion, Place and Purpose of Use in the Canadian River Basin in the State of New Mexico. Colfax County is the county affected by the diversion and in which the water has been and will be put to beneficial use. This notice is ordered to be published in the Albuquerque Journal. The applicant is requesting to change point of diversion, place and purpose of use of surface water by ceasing the diversion of 5.0676 acre-feet of surface water from the irrigation of 3.3784 acres of land located in part of the NWNE and part of the SWNE of Section 10, Township 26 North, Range 19 East, N.M.P.M., projected. The applicant proposes to transfer the consumptive use of 4.0 acre-feet of surface water from two points of diversion on the Cimarron River located at Latitude 3630'18.55314" North, Longitude 10454'59.82958" West, within the NWSWNE of Section 10, Township 26 North, Range 19 East, N.M.P.M., projected, and at Latitude 3630'27.25204" North, Longitude 10455'31.31317" West, within the SWNWNW of Section 10, Township 26 North, Range 19 East, N.M.P.M., projected. The second point of diversion is known historically as the MaxwellClutton Ditch point of diversion. The applicant proposes to begin the diversion of 4.0 acre-feet of surface water from two points of diversion on the Cimarron River located at Latitude 3631'49.363" North, Longitude 1050'22.607" West, within the NWNWSW of Section 33, Township 27 North, Range 18 East, N.M.P.M., projected, and Latitude 3630'38.70678" North, Longitude 10456'18.10477" West, within the SESESW of Section 4, Township 26 North, Range 19 East, N.M.P.M., projected, respectively for municipal purposes within the service area of the Village of Cimarron. All locations are within the Maxwell Land Grant within Colfax County. To view the application and supporting documentation contact the State Engineer District Office to arrange a date and time for an appointment located at District VII Office of the State Engineer, P.O. Box 481, 301 East 9th Street, Cimarron, New Mexico 87714. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights*; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, District VII Office of the State Engineer, P.O. Box 481, 301 East 9th Street, Cimarron, New Mexico, 87714 on or before Friday, April 17, 2020. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the District VII Office of the State Engineer, (575) 376-4565. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
