NOTICE is hereby given that on August 27, 2019, September 11, 2019 and again on October 31, 2019, High Lonesome Ranch, c/o Norman C. Ribble, P.O. Box 897, Elephant Butte, New Mexico 87935 and the City of Albuquerque, c/o David J. Simon, 1 Civic Plaza NW, Albuquerque, New Mexico 87102, filed with the STATE ENGINEER application No. SD-04760 into SP-5157 for a Permit to Change the Place of use of Surface Water rights under SD-04760 in the Rio Grande Stream System of the State of New Mexico. Bernalillo County is the County affected by the diversion and in which the water will be put to beneficial use. This notice is ordered to be published in the Albuquerque Journal (Bernalillo County). The applicants propose to discontinue the diversion of 62.4288 acre-feet per annum (afa) Farm Delivery requirement from the Duranes Ditch with a Point of Diversion on the Rio Grande at the Angostura Diversion Dam (Surface Permit SP-1690-2) of the MRGCD, on land owned by the MRGCD, located at a point where X=363,856 meters and Y=3,916,198 meters, UTM, NAD 83, Zone 13 North in the SW1/4 SE1/4 SE1/4, Section 3, Township 13 North, Range 4 East, NMPM, Sandoval County for the irrigation of 20.8096 acres of land owned by High Lonesome Ranch described as Tract 1A (17.8553 acres) and Tract 1C (2.9543 acres) on Plat for Tracts 1A, 1B & 1C of Eden Lands, MRGCD Map 35, within Section 12, Township 10 North, Range 2 East, NMPM, Bernalillo County. The move-from place of use is generally located at 1000 Gabaldon Road NW, which is east of the Rio Grande, south of the intersection of Gabaldon Road NW and I-40 in Albuquerque, Bernalillo County, New Mexico. The applicants propose to commence the diversion of said 62.4288 afa Farm Delivery Requirement from the Gallegos Ditch and Hackman Lateral with a Point of Diversion on the Rio Grande at the Angostura Diversion Dam, described above, for the irrigation of 20.8096 acres of land owned by City of Albuquerque described as a portion of the western part of Tract A of Los Poblanos Ranch (Los Poblanos Fields Major Public Open Space), MRGCD Maps 31 & 32, within Sections 31 & 32, Township 11 North, Range 3 East, NMPM. The move-to place of use is generally located east of the Rio Grande, northwest of the intersection of Montano Road and Tierra Viva Place NW in the City of Albuquerque, Bernalillo County, New Mexico. The applicants state "the water rights are needed by the City of Albuquerque to irrigate crops and open lands at the Los Poblanos and Anderson Fields". Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109, on or before February 14, 2020. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
