NOTICE OF INTENT TO REQUEST THE RELEASE OF FUNDS September 6, 2019 Bernalillo County Housing Department 1900 Bridge Blvd. SW Albuquerque, NM 87105 (505) 314-0200 This notice shall satisfy procedural requirements for activities to be undertaken by the Agency Name. REQUEST FOR THE RELEASE OF FUNDS On or about September 6, 2019, the Bernalillo County Housing Department will submit a request to the Mortgage Finance Authority (MFA) for the release of funds under Title II of the Cranston-Gonzales National Affordable Housing Act (NAHA) of 1990, as amended, for the HOME Investment Partnership Program (24 CFR Part 92) in the amount of $65,000 to undertake a project known as the House by House Reservation Rehabilitation Program for the purpose of rehabilitating single family homes owned and occupied by low income families. Approximately 4 home(s) to be rehabbed house(s) will be rehabilitated in the following counties: Bernalillo County and Sandoval County The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. The activities proposed satisfy HUD's 24 CFR Part 58 regulations and the National Environmental Policy Act. In accordance with 58.15, a tiered environmental review process has been performed. A Tiered review is a two-step environmental review process. Target areas have been identified and the following laws and authorities have been complied with pertaining to: Wetlands, Farmlands, Sole Source Aquifers, Wild and Scenic Rivers, Coastal Barriers and Coastal Zone protection. Compliance with the following laws and authorities will take place during the second step once properties within the target area have been identified: Floodplains, Historic Properties, Airport Clear Zones, Explosive and Flammable Operations, Toxic Materials and Lead Based Paint. An Environmental Review Record (ERR) that documents the environmental additional project information is contained in the Environmental Review Record (ERR) on file at the Bernalillo County Housing Department, 1900 Bridge Blvd. SW and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to MFA. All comments received by September 24, 2019 will be considered by the MFA prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS The Bernalillo County Housing Department certifies that Brett Engel of Acme Environmental Inc. in his capacity as the Certifying Environmental Official consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Bernalillo County Housing Department to use Program funds. OBJECTIONS TO THE RELEASE OF FUNDS HUD will accept objections to its release of funds and Bernalillo County Housing Department certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it is on one of the following bases: (a) the certification was not executed by the Certifying Officer of Bernalillo County Housing Department; (b) Bernalillo County Housing Department has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to CPD Environmental Review Officer, 500 Gold Avenue SW. 7th Floor, Suite 7301, PO Box 906, Albuquerque, NM 87103-0906.
