NOTICE is hereby given that on May 10, 2018, and amended on May 20, 2019, the John S. McCatharn Trust, c/o John S. McCatharn, P.O Box 19306, Albuquerque, NM 87119-0306, filed Application No. RG-2916 with the STATE ENGINEER for Permit to Change Point of Diversion and Change the Purpose of Use of Groundwater within the Rio Grande Underground Water Basin in the State of New Mexico. The applicant proposes to discontinue the diversion/consumptive use amount of 16.0 acre-feet per annum of groundwater under Permit No. RG-2916, from three supplemental wells owned by the John S. McCatharn Trust, for domestic and other (dairy and related) purposes of use, all located on land owned by the John S. McCatharn Trust, within the Rio Grande Underground Water Basin. Said three wells are described as RG-2916, located at a point described as where 34.987 North Latitude and -106.658 West Longitude intersect, and RG-2916-S, located at a point described as where 34.987 North Latitude and -106.658 West Longitude intersect, and RG-2916-S-2, located at a point described as where 34.988 North Latitude and -106.659 West Longitude intersect, WGS84, all located within the SE SE of Section 19, Township 9 North, Range 3 East, NMPM. More generally, said three wells are located within the former McCatharn Dairy, at 6363 Desert Rd. SE, Albuquerque, Bernalillo County, New Mexico. The place of use for said three wells is within 35 acres of land, owned by the John S. McCatharn Trust, located within the SE SE of Section 19, Township 9 North, Range 3 East, NMPM, being the former McCatharn Dairy, located at 6363 Desert Rd. SE, Albuquerque, Bernalillo County, New Mexico. The applicant further proposes to commence the diversion/consumptive use amount of said 16.0 acre-feet per annum of groundwater under Permit No. RG-2916, from two wells owned by the John S. McCatharn Trust, for irrigation and other (remediation of groundwater) purposes of use, both located on land owned by the John S. McCatharn Trust, within the Rio Grande Underground Water Basin. Said two wells are described as RG-2916 POD6 (a.k.a NMED Monitor Well #5), located at a point described as where 34.986 North Latitude and -106.658 West Longitude intersect, and RG-2916 POD7 (a.k.a NMED Monitor Well #6), located at a point described as where 34.986 North Latitude and -106.658 West Longitude intersect, WGS84, both located within the SE SE of Section 19, Township 9 North, Range 3 East, NMPM. The place of use for said two wells is within the same 35 acres of land, owned by the John S. McCatharn Trust, located within the SE SE of Section 19, Township 9 North, Range 3 East, NMPM, being the former McCatharn Dairy, located at 6363 Desert Rd. SE, Albuquerque, Bernalillo County, New Mexico. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, within ten (10) days after the date of the last publication of this Notice. Facsimiles (faxes) will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24 hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
