NOTICE is hereby given that on March 19, 2019 and again on March 27, 2019, Cedar Creek Water Coop., Inc., c/o Mike Griego, P.O. Box 241, Placitas, NM, 87043, filed Application No. RG-48788 POD4 with the STATE ENGINEER for Permit for Additional Groundwater Point of Diversion within the Middle Rio Grande Underground Water Basin of the State of New Mexico. The applicant proposes to drill and commence the use of proposed well RG-48788 POD4 to be drilled under emergency authorization issued March 28, 2019 to an approximate depth of 600 feet with 6-inch casing on Tract A2 of the Cedar Creek Subdivision, land owned by George and Carol Allen, to be located at latitude 35.330047 and longitude -106.447011 (WGS84) within the NE NE of Section 30, Township 13N, Range 5E, NMPM, to be supplemental to three (3) existing wells described in NM State Plane (NAD83), Central Zone, feet: well RG-48788 (POD1) located at X=1,581,887 and Y=1,575,887; well RG-48788-S (POD2) located at X=1,581,710 and Y=1,575,446; and well RG-48788 POD3 located at X=1,581,992 and Y=1,575,889; all located in NE NE of Section 30, Township 13N, Range 5E, NMPM, the for the continued diversion of 14.25 acre-feet per annum (AFA) consumptive use from all permitted wells for domestic, household, and housing subdivision purposes (wells RG-48788 PODs 1 and 2 are also permitted under RG-92731 for 3 AFA for multi-household domestic use under 72-12-1 NMSA) on approximately 129 acres of land owned by various owners within NE Section 30, Township 13N, Range 5E, NMPM. The proposed well RG-48788 POD4 and place of use are located approximately 4.2 miles northeast of the intersection of Interstate 25 and NM State Highway 165 in Sandoval County, New Mexico. The applicants state that per the authority of Section 72-12-24 NMSA, Cedar Creek Water Coop., Inc. is requesting emergency authorization to drill and use a supplemental well. Well RG-48788-S (POD2) has failed due to large amounts of silt infiltrating the well casing resulting in the inability of the pump to function. RG-48788 (POD1) is failing and has very limited capacity. RG-48788 POD3 is the only well for the entire community. The owners of the water right exercised from the original well and the appropriation of water from the supplemental well shall be the same amount of 14.25 acre feet of water allowed by the subject water right. The supplemental well shall be completed in the same underground stream, channel, artesian basin, reservoir or lake as the original well. An emergency situation exists in which delay caused by publication and hearing would result in crop loss or other serious economic loss due to the lack of water. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, 87109, within ten (10) days after the date of the last publication of this Notice. Facsimiles (505-383-4030) will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, [505-383-4030]. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
