AMENDED NOTICE OF SALE NOTICE IS HEREBY GIVEN that on March 26, 2019, at the hour of 10:00 a.m., the undersigned Special Master will, at the main entrance of the Valencia County Courthouse, 1835 Hwy. 314 SW, Los Lunas, New Mexico, sell all the right, title and interest of the above-named Defendants in and to the hereinafter described real estate to the highest bidder for cash. The property to be sold is located at 20 Rivendell Lane, Los Lunas, and is situate in Valencia County, New Mexico, and is particularly described as follows: A certain tract of land situate within projected Section 1, Township 6 North, Range 2 East, NMPM, Valencia County, New Mexico, being the northerly portion of Tract D-3 as shown on the plat showing split of Tract "D", Land of Don Driggers, filed in the office of the Valencia County Clerk, on June 6, 1986, and being more particularly described as follows: BEGINNING at the southwest corner of the tract herein described, said point being on the easterly right-of-way of the Tome Drain, whence U.S.B.R. Traverse Point Number B15-57 bears S 09 Deg. 37' 09" E, 1982.93 feet and following said right-of-way; thence N 28 Deg. 24' 39" E, 171.99 feet to the northwest corner, said point being the northwest corner of the aforementioned Tract D-3; thence, leaving said Right-of-way of the Tome Drain, S 79 Deg. 14' 43" E, 265.28 feet to the northeast corner; thence, S 28 Deg. 04' 50" W, 171.68 feet to the southeast corner; thence, N 79 Deg. 14' 43" W, 266.32 feet to the southwest corner and point of beginning of the tract herein described. ALSO A certain tract of land situate within projected Sections 11 and 12, Township 6 North, Range 2 East, NMPM, Valencia County, New Mexico, comprising a portion of Tract D-3, Plat showing split of Land of Don Driggers, as such tract is shown on Middle Rio Grande Conservancy District Property Map Number 83, and shown on said plat filed in the Office of the Valencia County Clerk on June 6, 1986, in Cabinet "E", folio 43, and being more particularly described as follows: BEGINNING at the southwest corner of the tract herein described, said corner being the southwest corner of the aforementioned Tract D-3, Land of Don Driggers, whence U.S.B.R. Traverse Point No. B15-57, bears S 25 Deg. 49' 15" E, 1505.61 feet, and following the easterly right-of-way of the Tome Drain, thence N 28 Deg. 24' 39" E, 681.89 feet to the northwest corner; thence leaving said right-of-way, S 79 Deg. 14' 43" E, 266.32 feet; thence N 28 Deg. 04' 50" E, 171.68 feet to a point on the north line of said Tract D-3, thence S 79 Deg. 14' 43" E, 26.18 feet to the northeast corner, also the northeast corner of Said Tract D-3, thence, S 28 Deg. 04' 50" W, 41.91 feet; thence S 28 Deg. 04' 50" W, 779.24 feet to the southeast corner, also being the southeast corner of said tract D-3; thence, N 84 Deg. 48' 10" W, 307.53 feet to the southwest corner and point of beginning of the tract herein described. THE FOREGOING SALE will be made to satisfy a judgment rendered by the above Court in the above entitled and numbered cause on February 21, 2019, being an action to foreclose a mortgage on the above described property. The Plaintiff's Judgment, which includes interest and costs, is $540,808.41 and the same bears interest at 4.125% per annum from December 01, 2018, to the date of sale. The Plaintiff and/or its assignees has the right to bid at such sale and submit its bid verbally or in writing. The Plaintiff may apply all or any part of its judgment to the purchase price in lieu of cash. The sale may be postponed and rescheduled at the discretion of the Special Master. NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.
