BEFORE THE NEW MEXICO PUBLIC REGULATION COMMISSION Case No. 19-00041-UT IN THE MATTER OF THE APPLICATION OF HENRY G. COORS AND JORIE GNIOTCZYNSKI TO TRANSFER 100% OF THE ISSUED AND OUTSTANDING STOCK IN SOUTH HILLS WATER COMPANY FROM HENRY G. COORS TO JORIE GNIOTCZYNSKI HENRY G. COORS AND JORIE GNIOTCZYNSKI APPLICANTS NOTICE TO SOUTH HILLS WATER COMPANY CUSTOMERS NOTICE is hereby given that: The following matters pertaining to the above-captioned case are pending before the New Mexico Public Regulation Commission ("Commission"): On February 5, 2019, Henry G. Coors, the owner of South Hills Water Company filed an application requesting approval to sell his stock and all of the assets of South Hills Water Company to Jorie Gniotczynski. Commission approval of these transactions would also include the transfer of South Hills Water Company's certificate to operate as a public utility providing water and sewer services to Jorie Gniotczynski. The terms and conditions of the sale and transfer are set forth in the Purchase Agreement attached to the Application. The terms and conditions include a representation that the purchase of South Hills Water Company includes the acquisition of the water rights for 70.00 acre feet of consumptive use described in the permit in OSE file number RG25500 and RG-25500S approved by the Office of the State Engineer May 7, 1980, without warranties, of which ninety-nine point sixty-six acre feet have been put to beneficial use. Further, the Application asserts that if the requests are approved, South Hills Water Company will continue to operate, under the new owner, as it now operates. The Application states that the buyer, Ms. Gniotczynski, lives within area served by South Hills Water Company and has collected payments, deposited payments, kept books and records, filed reports, supervised maintenance, installed billing software, evaluated operation and maintenance problems and dealt with customers for the past six (6) years. The Commission has determined that approval of the related requests and terms as set forth in the Application are required pursuant to NMSA 1978, 62-6-12 and 62-6-13 NMSA 1978 and 62-9-5 and 62-9-1 NMSA 1978. The present schedule for this case is as follows: A. Any person who desires to become a party to this case must file a Motion for Leave to Intervene, pursuant to NMAC, on or before March 29, 2019. B. Applicants will be required to provide testimony and supplemental information by March 27, 2019. C. Staff shall, and any intervenors may, file direct testimony by May 30, 2019. D. Any rebuttal testimony shall be filed by June 10, 2019. E. A public hearing to hear and receive testimony, exhibits, arguments and other appropriate matters relevant to this proceeding will be held beginning at 9:30 A.M. on June 17, 2019, in the Ground Floor Hearing Room of the PERA Building, 1120 Paseo de Peralta, Santa Fe, New Mexico. The procedural dates and requirements provided herein are subject to further Order of the Commission or Hearing Examiner. Interested persons should contact the Commission at 505-827-6956 for confirmation of the hearing date, time and place, since hearings are occasionally rescheduled. The Commission's Utility Division Procedures, 1.2.2 NMAC, shall apply to this case except as modified by Order of the Commission or Hearing Examiner.
