NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Santa Fe County, New Mexico, commonly known as #37 Arroyo Alamo West, Espanola, New Mexico 87532, and more particularly described as follows: LOT 1C, AS SHOWN AND DELINEATED ON THE PLAT OF SURVEY ENTITLED, "PLAT OF SURVEY REQUESTED BY OJAS S. KHALSA SECTION 8, T. 20 N., R. 9 E., N.M.P.M. PORTION OF SHC 6254 TR. 1, SANTA FE COUNTY, NEW MEXICO", SURVEYED BY JOHN PAISANO JR., R.P.L.S., FILED NOVEMBER 9, 1989 AS DOCUMENT NO. 692,201 AND RECORDED IN PLAT BOOK 209, PAGE 007, IN THE RECORDS OF SANTA FE COUNTY, NEW MEXICO. The sale is to begin at 1:00p.m. on March 19, 2019, outside the front entrance of the First Judicial District Court, 225 Montezuma Ave, Santa Fe, New Mexico 87504 at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted United States of America, acting through the Rural Housing Service ("USDA"). USDA was awarded in rem Judgment on February 4, 2019, in the principal sum on First Note of $64,892.71, plus interest due thereon through December 17, 2018 on First Note in the amount of $23,368.95, and accruing thereafter at the rate of 9.25% per annum ($16.45 per diem) until paid, plus late fees of $117.65, plus escrow advances of $1,554.30, plus miscellaneous fees of $8,933.47, plus in rem subsidy recapture on the First Note of $79,002.98, plus principal balance on Second Note of $36,180.61, plus outstanding interest due on the Second Note through December 17, 2018 in the amount of $10,614.60 and accruing thereafter at the rate of 9.25% per annum ($7.31 per diem) until paid, plus late charges of $52.64, plus in rem interest recapture on Second Note in the amount of $16,491.70, plus attorney's fees of $1,224.00, and costs of $735.64, with interest on the aforesaid amounts at the rate of 9.25% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of the Defendant(s) as specified in the Judgment filed herein.
