PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Taos County, New Mexico, commonly known as 3 Vigil Road, Questa, NM 87556, and more particularly described as follows: A certain tract of land situated in a part of Section 1, Township 28 North, Range 12 East, New Mexico Principal Meridian, Questa, County of Taos, State of New Mexico: described as part of SHC No. 5337, Tract 2, of the 1916 USGLO Survey of the Small Holding Claims within Section 1, Township 28 North, Range 12 East, NMPM; also described as part of Tract 44, Map 13, Survey 7 of the 1941 Taos County Reassessment Survey, Taos County, New Mexico; further described as Lot 4 and the northerly one half of Lot 3, Embargo Estates Subdivision, being more particularly described as follows: BEGINNING at the southwest corner of this tract, a 1/2 inch rebar and plastic cap, NMLS # 14833, set, whence corner 6 of said SHC No. 5337, a bent USGLO cap monument found, bears South 03 08' 12'' West, a distance of 500.67 feet; Thence North 03 08' 12'' East, a distance of 108.03 feet to a 1/2 inch rebar with plastic cap, NMLS #14833 found at the west common corner to said lots 3 and 4; Thence North 03 08' 12'' East, a distance of 181.89 feet to a 5/8 inch rebar and plastic cap, NMLS #12349, found on the southerly limit of use of Old State Road No. 3; Thence North 71 32' 04'' East along said limit of use. a distance of 115.44 feet to a 1/2 inch rebar and plastic cap, NMLS #14833, found on the westerly right-of-way of a 20 foot road; Thence departing said limit of use, South 02 51' 06'' West, a distance of 218.53 feet to a 1/2 inch rebar and plastic cap, NMLS #14833, found at the east corner common to said lots 3 and 4 Thence South 02 51' 06'' West, a distance of 108.03 feet to a 1/2 inch rebar with plastic cap, NMLS #14833 set; Thence departing said westerly right-of-way. North 89 56' 35' West, a distance of 109.11 feet to the point of beginning. This tract contains 0.766 acres, more or less. If there is a conflict between the legal description and the street address, the legal description shall control. The sale is to begin at 11:00 am on April 1, 2019, Taos County Courthouse, City of Taos, County of Taos, State of New Mexico, at which time I will sell to the highest and best bidder for cash, in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Amended Default Judgment granted on January 17, 2019, in the total amount of $122,760.24 with interest at the rate of 4.875% per annum from October 3, 2018, through the date of the sale. The sale is subject to the entry of an Order by this Court approving the sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney. NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, and all taxes and utility liens, special assessments and taxes that may be due.
