NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Grant County, New Mexico, commonly known as 710 Cielo Azul, Silver City, New Mexico 88061, and more particularly described as follows: LOT 18 OF TIERRA DE PLATA SUBDIVISION, A RE-SUBDIVISION OF BLOCKS 193-194 AND THAT PORTION OF VACATED SILVER CITY STREET LYING BETWEEN COLLEGE AVENUE AND TENTH STREET, ORIGINAL TOWNSITE OF SILVER CITY, GRANT COUNTY, NEW MEXICO, PLATS FILED OF RECORDS ON MAY 9, 1997 IN PLAT BOOK 7, PAGE 177. The sale is to begin at 2:45 p.m. on February 1, 2019, outside the front entrance of the Sixth Judicial District Court, 201 N. Cooper St, Silver City, NM 88061 at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted United States of America, acting through the Rural Housing Service ("USDA"). USDA was awarded in rem Judgment on December 6, 2018, in the principal sum of $45,941.40, plus interest due thereon through October 12, 2018, in the amount of $3,556.49, and accruing thereafter at the rate of 6.875% per annum ($8.65 per diem) until paid, plus late fees of $76.50, plus miscellaneous fees of $1,113.92, plus in rem subsidy recapture of $19,702.08, plus attorney's fees of $1,077.50, and costs of $683.51, with interest on the aforesaid amounts at the rate of 6.875% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of the Defendant as specified in the Judgment filed herein.
