Kunkel You are hereby notified that a civil action has been filed against you in the District Court of Torrance County, New Mexico, by Plaintiff, US Bank National Association, not in its individual capacity but solely as Trustee for the CIM Trust 2017-8 Mortgage-Backed Notes, Series 2017-8, in which Plaintiff prays for the foreclosure of its Note and Mortgage encumbering the real estate and improvements located at Section 20 Township 09N Edgewood, New Mexico 87009, in Torrance County, New Mexico, and more particularly described as follows: Parcel A: The southwest Quarter of the Southwest Quarter of the southwest quarter (sw1/4se1/4se1/4) of section twenty (20), township nine (9) north, range eight (8) east, N.M.P.M., AKA a portion of tract designated "B", being a portion of the southeast Quarter (SE1/4) of section twenty (20), township nine (9) north, range eight (8)East, N.M.P.M., as the same is shown and designated on that certain plat entitled "Exemption No. 7 of lot line adjustment plat of lands of F. Ernest Sweet & Her sole and separate corporation", prepare by Timothy Ray Oden, N.M.P.S. #8667, dated July 13, 1998, filed for record on July 20, 1998 at 3:52 o'clock P.M. as document number 9830773, and filed in cabinet D, Slide 204, Plat records of Torrance County, New Mexico. Parcel B: The southwest Quarter of the Southwest Quarter (SW1/4SE1/4), the North Half of the Southeast Quarter of the southeas Quarter (N1/2SE1/4SE1/4), AKA a portion of Tract designated "B", being a portion of the Southeast Quarter (SE1/4) of section Twenty (20) township nine (9) north, range eight (8) east, N.M.P.M., as the same is shown and designated on that certain plat entitled "Exemption No. 7 of lot line adjustment plat of lands of F. Ernest Sweet and her sole and separate corporation", prepare by Timothy ray Oden, N.M.P.S #8667, dated July 13, 1998, filed for record on July 20, 1998 at 3:52 o"clock, P.M, as document 9830773, and filed in Cabinet D, slide 204, plat records of Torrance county, New Mexico, including any improvements, fixtures, and attachments, such as, but not limited to, mobile homes. If there is a conflict between the legal description and the street address, the legal description shall control. You are further notified that Plaintiff prays that the aforementioned real property be sold according to the law and practice of this Court to pay the mortgage lien held by Plaintiff, and that the interests of each Defendant, and all persons claiming under or through them, and all other persons bound by these proceedings, be barred and foreclosed of all rights, interests, and claims to the aforementioned real property, and for such other and further relief as the Court may deem just and proper. You are further notified that unless you enter or cause to be entered your appearance or file responsive pleadings or motions in said cause within thirty (30) days of the third consecutive publication of this Notice of Suit, judgment will be rendered against each Defendant by default, and the relief prayed for by Plaintiff will be granted.
