COMMISSIONER OF PUBLIC LANDS NOTICE OF PUBLIC AUCTION FOR SALE OF LAND BY SEALED BID SALE No. LS-0118, 0.792 +/- acres Santa Fe County, New Mexico The Commissioner of Public Lands ("Commissioner") gives notice that, pursuant to the New Mexico Enabling Act (36 Stat. 557), NMSA Sections 19-7-1 and 19-7-2, Rule 19.2.14 NMAC, and the sealed bid auction process described in this Notice, he is offering to sell state trust land. The sale will be conducted by sealed bid as set forth in the Bid Information Packet described below. The state trust land being offered (the "Land") is located in Santa Fe County, New Mexico, and further described as: Property Description Tract B Remainder: Part of Lot 4, Section 36, Township 14 North, Range 9 East containing an area of 18,870 square feet or 0.433 acres more or less. Property Description Tract B Hwy 41Right of Way Take: Part of Lot 4, Section 36, Township 14 North, Range 9 East containing an area of 15,660 square feet or 0.359 acres more or less. A complete legal land description is available within the Bid Information Packet The Land is located in Galisteo, N.M., along New Mexico State Highway 41, South of Santa Fe County Road 42. 1. The Land is offered "AS IS"; the Commissioner does not make any representations or provide any warranties regarding title to the Land or its condition or fitness for any purpose. The Land is offered for a cash sale (i.e., full payment in cash due at closing) as a single tract; bids for less than the entire tract will not be considered. 2. Details of this offer, applicable rules, bidding instructions and forms are included in the Bid Information Packet, which can be obtained online at www.nmstatelands.org, or by written request, in person, by telephone or email. The Bid Information Packet is incorporated herein by reference. The Packet should be reviewed in detail before submitting a bid. 3. The Minimum Bid is fifty-five thousand dollars ($55,000.00). The Commissioner may select the highest and best qualified bid or reject all bids. 4. Bids must be accompanied by the Deposits in the amounts set forth below. Deposits must be in the form specified in the Bid Information Packet. Failure to include the required Deposits will result in disqualification. The successful bidder will be required to pay all other costs associated with the transaction. Except for the non-refundable three thousand dollars ($3,000.00) Sale Application Fee, the Deposits of unsuccessful bidders will be refunded. See Bid Information Packet for additional information and requirements regarding the required Deposits. Transfer of the Land will be subject to all valid leases, easements and other encumbrances (collectively, "encumbrances") shown in the records of the State Land Office and/or the Santa Fe County Clerk's Office. Bidders are responsible for verifying encumbrances and their effect on the Land. 6. The Land will be conveyed by a single patent, reserving to the State all minerals of whatsoever kind, geothermal resources, and certain water rights, together with rights of access and surface use necessary for or incident to exploration for and extraction and removal of such minerals, geothermal resources, and water rights. When issuing the patent, the Commissioner will offer to execute a surface non-disturbance agreement as to any future exploration for or production of minerals for a five hundred dollars ($500.00) fee. 7. Bids, made in strict conformity with the requirements set out in the Bid Information Packet, must be submitted in a sealed package marked "Land Sale No. LS-0118" and addressed to the Commissioner, c/o Craig Johnson, Acting Assistant Commissioner, Commercial Resources Division, at the State Land Office address provided above by 4:00 p.m. on September 28, 2018. 8. Sealed bids will be opened on October 1, 2018 at 9:00 a.m. in Morgan Hall located within the State Land Office. Sealed bids not complying with the requirements set forth in the Bid Information Packet are subject to disqualification. Conforming bids received will be evaluated by the Commissioner. The Commissioner reserves the right to reject all bids submitted and to re-offer the Land for lease, sale and/or exchange on the same or different terms.
