NOTICE OF SALE NOTICE IS HEREBY GIVEN that on July 17, 2018, at the hour of 11:45 a.m., the undersigned Special Master will, at the south door of the Roswell Police Department, 128 West Second Street, Roswell, New Mexico, sell all the right, title and interest of the above-named Defendants in and to the hereinafter described real estate to the highest bidder for cash. The property to be sold is located at 26 Deborah Drive, Roswell, and is situate in Chaves County, New Mexico, and is particularly described as follows: ALL of LOT EIGHT (8), AND Part of LOT SEVEN (7), more particularly described as follows: BEGINNING at the East corner common to Lots 7 and 8; THENCE Southeasterly along a curve whose radius is 125, a distance of 10 feet; THENCE South 45 deg. 16' West, a distance of 194.9 feet to the West line of lot 7; THENCE North 0 deg. 11' East along the West line of Lot 7, a distance of 50.39 feet to the West corner of Lots 7 and 8; THENCE Northeasterly along the line common to Lots 7 and 8, a distance of 162.6 feet to the point of beginning, AND Part of LOT NINE (9), more particularly described as follows: BEGINNING at the West corner common to Lots 8 and 9, THENCE North 58 deg. 55' East, a distance of 64.3 feet; THENCE North 52 deg. 53' East, a distance of 29.2 feet; THENCE North 78 deg.45' East, a distance of 30.7 feet to a point on the East line of said Lot 9, THENCE South 0 deg. 09' West along the East line of said Lot 9, a distance of 17.0 feet to the East corner common to said Lots 8 and 9; THENCE South 69 deg. 45' West along the line common to said Lots 8 and 9, a distance of 115.4 feet to the point of beginning, ALL BEING in BLOCK FOUR (4) of COUNTRY CLUB HEIGHTS SUBDIVISION NO. 2, in the City of Roswell, County of Chaves and State of New Mexico, as shown on the Official Plat filed in the Chaves County Clerk's Office on June 23, 1961 and recorded in Book C of Plat Records, Chavez County, New Mexico, at Page 153. THE FOREGOING SALE will be made to satisfy a judgment rendered by the above Court in the above entitled and numbered cause on June 14, 2018, being an action to foreclose a mortgage on the above described property. The Plaintiff's Judgment, which includes interest and costs, is $128,938.12 and the same bears interest at 4.375% per annum from November 2, 2017, to the date of sale. The Plaintiff and/or its assignees has the right to bid at such sale and submit its bid verbally or in writing. The Plaintiff may apply all or any part of its judgment to the purchase price in lieu of cash. The sale may be postponed and rescheduled at the discretion of the Special Master. NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, all recorded and unrecorded liens not foreclosed herein, and all recorded and unrecorded special assessments and taxes that may be due. Plaintiff and its attorneys disclaim all responsibility for, and the purchaser at the sale takes the property subject to, the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any.
