NOTICE OF SALE NOTICE IS HEREBY GIVEN that on August 9, 2018, at the hour of 2:00 PM, the undersigned Special Master, or his designee, will, at the front entrance of the Valencia County Courthouse, at 1835 Hwy 314 SW, Los Lunas, NM 87031, sell all of the rights, title, and interests of the above-named Defendants, in and to the hereinafter described real property to the highest bidder for cash. The property to be sold is located at 1009 Camino Del-llano, Belen, New Mexico 87002, and is more particularly described as follows: Tract lettered "A" of the Staked Boundary Survey of Tract "A" Land of Ivy S. Lee et. al., in Valencia County, New Mexico, as the same is shown and designated on said plat filed with the Valencia County Clerk on November 30, 2004, in Cabinet L, folio 397, being more particularly described as follows: Tract 240 A1-J-2 and Tract 240 B-1-B-10-B as the same is shown on Middle Rio Grande Conservancy District Property Map 100, within the Belen Grant, projected Section 13, Township 5 North, Range 2 East, N.M.P.M., City of Belen, Valencia County, New Mexico, and being more particularly described as follows: BEGINNING at the northeast corner of the tract herein described, a point on the southerly line of Sosimo Padilla Boulevard, whence the U.S.C. & G.S. Triangulation Station "US-85-15" bears N. 85 55' 25" E., 86.45 feet; thence, N. 88 12' 51" E., 104.07 feet; Thence N. 22 53' 40" E., 3,194.74 feet distant and thence leaving said southerly line of Sosimo Padilla Boulevard and running S. 01 01' 02" E., 190.48 feet to the southeast corner; thence, N. 8940' 02" W., 57.90 feet; thence, N. 02 51' 48" W., 40.91 feet; thence, N. 89 19' 41" W., 34.93 feet to the southwest corner; thence, N. 03 01' 12" E., 144.35 feet to the northwest corner, a point on the aforesaid southerly line of Sosimo Padilla Boulevard; thence, N. 87 10' 18" E., 94.00 feet along the southerly line of Sosimo Padilla Boulevard to the northeast corner and point of beginning. including any improvements, fixtures, and attachments, such as, but not limited to, mobile homes. , (hereinafter the "Property"). If there is a conflict between the legal description and the street address, the legal description shall control. The foregoing sale will be made to satisfy an In Rem foreclosure judgment rendered by this Court in the above-entitled and numbered cause on June 25, 2018, being an action to foreclose a mortgage on the Property. Plaintiff's In Rem judgment is in the amount of $147,406.95, and the same bears interest at the rate of 9.5%, accruing at the rate of $38.37 per diem. The Court reserves entry of final In Rem judgment against Defendant, Ernest Lee, for the amount due after foreclosure sale, including interest, costs, and fees as may be assessed by the Court. Plaintiff has the right to bid at the foregoing sale in an amount equal to its In Rem judgment, and to submit its bid either verbally or in writing. Plaintiff may apply all or any part of its In Rem judgment to the purchase price in lieu of cash. In accordance with the Court's decree, the proceeds of sale are to be applied first to the costs of sale, including the Special Master's fees, and then to satisfy the above-described In Rem judgment, including interest, with any remaining balance to be paid unto the registry of the Court in order to satisfy any future adjudication of priority lienholders. NOTICE IS FURTHER GIVEN that in the event that the Property is not sooner redeemed, the undersigned Special Master will, as set forth above, offer for sale and sell the Property to the highest bidder for cash or equivalent, for the purpose of satisfying, in the adjudged order of priorities, the judgment and decree of foreclosure described herein, together with any additional costs and attorney's fees, including the costs of advertisement and publication for the foregoing sale, and, reasonable receiver and Special Master's fees in an amount to be fixed by the Court. The amount of the In Rem judgment due is $147,406.95, plus interest to and including date of sale in the amount of $10,666.86, for a total In Rem judgment of $158,073.81. The foregoing sale may be postponed and rescheduled at the discretion of the Special Master, and is subject to all taxes, utility liens and other restrictions and easements of record, and subject to a one (1) month right of redemption held by the Defendant(s) upon entry of an order approving sale, and subject to the entry of an In Rem order of the Court approving the terms and conditions of sale.
