NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Valencia County, New Mexico, commonly known as 659 Los Lentes Road SE, Los Lunas, New Mexico 87031, and more particularly described as follows: LOT SIX (6) OF TABET ADDITION, AS SHOWN ON PLAT, FILED FOR RECORD IN THE OFFICE OF THE VALENCIA COUNTY CLERK, VALENCIA COUNTY, NEW MEXICO ON JANUARY 22, 1987 IN BOOK F, PAGE 72. SUBJECT, HOWEVER, TO ALL VALID OUTSTANDING EASEMENTS, RIGHTS OF WAY, MINERAL LEASES, MINERAL RESERVATIONS, AND MINERAL CONVEYANCES OF RECORD. The sale is to begin at 10:10 a.m. on July 18, 2018, outside the front entrance of the Thirteenth Judicial District Court, 1835 Hwy 314 SW, Los Lunas, New Mexico 87031 at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted United States of America, acting through Rural Housing Service ("USDA").USDA was awarded in rem Judgment on June 4, 2018, in the principal sum of Note1 of $33,999.58, plus interest through January 15, 2018, in the amount of $10,311.27, and accruing thereafter at the rate of 6.50% per annum ($6.05 per diem) until paid, plus late fees in the amount of $217.09, plus escrow advances in the amount of $1,195.19, plus miscellaneous fees in the amount of $7,596.29, plus in rem subsidy recapture on Note1 in the amount of $26,244.54, plus balance due to USDA on Note2 in the amount of $3,101.14, plus outstanding interest due on the Note2 from January 15, 2018 in the amount of $940.53, plus late charges on Note2 in the amount of $19.55, plus in rem interest subsidy recapture on Note2 in the amount of $2,412.98, plus attorney's fees in the amount of $1,240.00, and costs in the amount of $1,035.28, with interest on the aforesaid amounts at the rate of 6.50% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of the Defendant(s) as specified in the Judgment filed herein.
