NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 5004 San Timoteo Avenue NW, Albuquerque, New Mexico 87114, and more particularly described as follows: LOT NUMBERED SEVEN-P1 (7-P1) IN BLOCK NUMBERED ONE (1), PALOMA DEL STATUTE OF LIMITATIONS AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON APRIL 11, 1996. The sale is to begin at 9:50AM. on July 26, 2018, outside the front entrance of the Second Judicial District Court, 400 Lomas NW, Albuquerque, NM 87102 at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Bank of The West ("BOW"). BOW was awarded an in rem Judgment on June 5, 2018, in the principal sum of $19,860.06, plus outstanding interest due on the Note from April 11, 2017 through June 13, 2017 at the rate of 3.75%, in the amount of 131.13, plus outstanding interest due on the Note from June 14, 2017 through July 11, 2017, at the rate of 4.750% in the amount of 72.50, plus outstanding interest due on the Note From July 12, 2017 through January 12, 2018 at the rate of 5.000% in the amount of $500.72, plus outstanding interest due on the Note from January 12, 2018 through March 29, 2018 at the rate of 5.250% in the amount of 217.10, plus late charges in the amount of $25.00, plus attorney's fees in the amount of $1,773.75, and costs in the amount of $689.40, with interest on the aforesaid amounts at the rate of 5.250% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to prior mortgages of record, to the one (1) month right of redemption in favor of the Defendant(s) as specified in the Judgment filed herein. The mortgage foreclosed herein is believed to be a second lien mortgage.
