NOTICE OF FORECLOSURE SALE OF REAL PROPERTY NOTICE IS HEREBY GIVEN that on June 19, 2018, at 10:15 a.m., at the main entrance of the Bernalillo County District Courthouse, 400 Lomas, N.W., Albuquerque, Bernalillo County, New Mexico, the undersigned Special Master will sell at public auction for cash, the property located at 5201 Camino Del Sol, N.E., #A, Albuquerque, Bernalillo County, New Mexico, and more particularly described as: A certain parcel of land situate within the Elena Gallegos Grant, within the city limits of the City of Albuquerque, Bernalillo County, New Mexico; being and comprising a portion of TRACT "A", UNIT 2 OF ACADEMY ESTATES, an addition to the City of Albuquerque, Bernalillo County, New Mexico, as the same as shown and designated on the plat of said addition, filed in the office of the County Clerk of Bernalillo County, New Mexico, on September 30, 1971, in Plat Book D4, page 167. Being more particularly described by metes and bounds survey as follows: BEGINNING at the Northeast corner of the parcel herein described (a point on the Westerly line of Camino Del Sol, N.E.); whence the point of intersection of the Southerly line of Spain Road, N.E., with the Westerly line of Camino Del Sol, N.E., bears N. 33 deg. 00' 00" E., 242.00 feet distance; thence, S. 33 deg. 00' 00" W., 162.65 feet distance along the said Westerly line of Camino Del Sol, N.E. to a point of curvature; thence, Southwesterly, 25.60 feet distance along the arc of a curve bearing to the right along the said Westerly line of Camino Del Sol, N.E.. (said curve having a radius of 25.00 feet and a chord which bears S. 62 deg. 20' 08" W., 24.50 feet distance) to a point of reverse curvature; thence, Southwesterly, 115.55 feet distance along the arc of a curve bearing to the left (said curve having a radius of 50.00 feet and a chord which bears S. 25 deg. 18' 12" W., 91.50 feet distance) to a point on curve on the Southerly line of aforementioned Tract "A"; thence, Northwesterly, 314.48 feet distance along the arc of a curve bearing to the Left along the Southerly boundary line of aforementioned Tract "A". (said curve having a radius of 1,153.00 feet and a long chord which bears N. 79 deg. 18' 00" W., 313.51 feet distance) to the Southwest corner of the parcel herein described (a point on curve on the Southerly boundary line of aforementioned Tract "A") thence, N. 01 deg. 21' 00" E., 150.28 feet distance to a point; thence, S. 88 deg. 30' 00" E., 51.00 root distance to a point; thence, N. 00 deg. 51' 00" E., 115.00 feet distance to the Northwest corner of the parcel herein described; thence, S. 78 deg. 41' 33" E., 286.68 feet distance to a point; thence, N. 33 deg. 00' 00" E., 35.74 feet distance to a point; thence, S. 57 deg. 00' 00" E., 120.00 feet distance to the Northeast corner and place of beginning of the parcel herein described and containing 95,085.65 Square feet (2.183 acres), more or less. The foregoing sale will be made to satisfy a Default Judgment, Decree of Foreclosure, Order of Sale, and Appointment of Special Master entered by the Court in the above-captioned cause on March 27, 2018, being an action to foreclose a judgment lien on the above-described property. The Plaintiff has been granted a money judgment in the amount of TEN THOUSAND THIRTY-FOUR AND 06/100 DOLLARS ($10,034.06), plus interest accruing thereafter at the rate of 8.75% per annum, plus costs and attorney fees, plus costs of sale, and Special Master's fees. Plaintiff has the option of using all or any portion of Plaintiff's Judgment in lieu of cash atthe sale. Notice is given that the purchaser at the foreclosure sale shall take title to the Property subject to a nine (9) month right of redemption.
