NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Valencia County, New Mexico, commonly known as 205 Loma Verde Drive, Belen, New Mexico 87002, and more particularly described as follows: LOT NUMBERED NINE (9) IN BLOCK "C" OF MISSION VIEJO, A REPLAT OF A PORTION OF UNIT 7, AND A PORTION OF UNIT 10, ENCHANTED MESA, FILED ON MARCH 11, 1988, IN BOOK F, PAGE 123, RECORDS OF VALENCIA COUNTY, NEW MEXICO. The sale is to begin at 10:45 a.m. on May 21, 2018, outside the front entrance of the Thirteenth Judicial District, 1835 Hwy 314 SW, Los Lunas, New Mexico 87031 at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted USDA. USDA was awarded an in rem Judgment on March 15, 2018, in the principal sum of $57,401.86, plus interest due on the Note through December 1, 2017, in the amount of $19,581.42, and accruing thereafter at the rate of 8.750% per annum ($13.76 per diem) until paid, plus late fees in the amount of $131.95, plus fees assessed in the amount of $13,775.00, plus escrow advances in the amount of $338.72, plus in rem subsidy recapture in the amount of $75,414.75, plus attorney's fees in the amount of $1,400.00, and costs in the amount of $1,021.13, with interest on the aforesaid amounts at the rate of 8.750% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of the Defendants as specified in the Judgment filed herein.
