NOTICE OF SALE Notice is given that the real property described below in Valencia County, New Mexico, will be sold to the highest bidder for cash or certified funds on March 27, 2018 at 9:30 a.m. at the front steps of the Thirteenth Judicial District Court located at 1835 Highway 314 South West, Los Lunas, NM 87031. The sale arises out of a Summary and Default Judgment entered on February 14, 2018, upon an indebtedness and foreclosure of mortgage. The amount of the unsatisfied judgment of Plaintiff is $112,779.22 plus accrued interest pursuant to the terms of the judgment to date of sale in the amount of $1,565.48 for a total judgment through the date of sale of $112,779.22, plus publication costs, the Special Master fee and all other amounts to which Plaintiff is entitled under the Note and Mortgage. The real property is located in Bernalillo County, New Mexico, (the "Property") and is more particularly described as follows: which Property is more commonly known as 39 Viasa Road, Los Lunas, NM 87031 (the "Property"). The purchaser at the foreclosure sale shall take title to the Property "as is," in its present condition, subject to the valuation of the Property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any; and, free and clear of any and all claims of the parties subject, however, to the following: A. To a one month right of redemption; B. To any patents, reservations, easements, restriction of record and assessments; C. To any unpaid ad valorem real property taxes; D. Any municipal liens or assessments. and, E. Any prior unpaid liens of record. NOTICE IS FINALLY GIVEN that Plaintiff may bid and purchase the Property at the foreclosure sale and may apply all or a portion of its judgment toward the purchase price. NOTICE IS FURTHER GIVEN that this sale may be subject to a bankruptcy filing, a payoff, a reinstatement or any other condition that would cause the cancellation of this sale. Further, if any of these conditions exist, this sale will be null and void. The successful bidder's funds shall be returned, and the Special Master and the mortgagee giving this notice shall not be liable to the successful bidder for any damages.
