NOTICE OF FORECLOSURE SALE STATE OF NEW MEXICO COUNTY OF BERNALILLO SECOND JUDICIAL DISTRICT WELLS FARGO BANK, N.A., Plaintiff, vs. Case No.: D-202-CV-2015-02128 JACK T. VIGIL AND CHRISTOPHER M. TORREZ AS CO-PERSONAL REPRESENTATIVES OF THE ESTATE OF RONALD D. QUINONES AKA RON D. QUINONES, DECEASED; STATE OF NEW MEXICO TAXATION AND REVENUE DEPARTMENT; MOANA CONDOMINIUM ASSOCIATION, INC., Defendants. PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 1100 Alvarado Drive Southeast, Unit 105, Albuquerque, NM 87108, and more particularly described as follows: UNIT NO. 105 OF THE MOANA CONDOMINIUMS, A CONDOMINIUM REGIME ESTABLISHED PURSUANT TO THAT CERTAIN "DECLARATION OF CONDOMINIUM PLAN FOR MOANA CONDOMINIUMS" FILED OF RECORD ON MARCH 26, 1982, IN BOOK MISC. 919, PAGE 303, RECORDS OF BERNALILLO COUNTY, NEW MEXICO (HEREIN "THE DECLARATION"), THE DIMENSIONS OF SAID UNIT BEING MORE PARTICULARLY DESCRIBED IN THE FLOOR PLANS ATTACHED AND INCORPORATED AS EXHIBIT "D" TO THE DECLARATION. TOGETHER WITH AN UNDIVIDED PERCENTAGE OWNERSHIP INTEREST IN THE "COMMON AREAS AND FACILITIES" AS DEFINED IN THE DECLARATION AND MORE PARTICULARLY SHOWN ON EXHIBIT "A" ATTACHED TO AND INCORPORATED HEREIN AS PART OF THE DECLARATION. TOGETHER WITH THE RIGHTS, IF ANY, OF THE OWNER OF THE UNIT HEREBY CONVEYED IN "LIMITED COMMON AREAS" AS MORE PARTICULARLY SET FORTH IN THE DECLARATION. TOGETHER WITH THE RIGHT OF INGRESS AND EGRESS OVER AND ACROSS THE COMMON AREAS AND FACILITIES OF THE MOANA CONDOMINIUMS TO AND FROM THE UNIT HEREBY CONVEYED AND THE RIGHT TO USE AND ENJOY THE COMMON AREAS AND FACILITIES OF THE MOANA CONDOMINIUM IN COMMON WITH THE OWNERS AND OCCUPANTS OF THE OTHER UNITS WITHIN THE MOANA CONDOMINIUMS. If there is a conflict between the legal description and the street address, the legal description shall control. The sale is to begin at 10:15 am on April 10, 2018, front entrance of the Second Judicial District Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash, in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the foreclosure Judgment granted on February 8, 2018 in the total amount of $30,191.99 with interest at the rate of 6.250% per annum from May 30, 2016 through the date of the sale. The sale is subject to the entry of an Order by this Court approving the sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney. NOTICE IS FURTHER GIVEN that the real property and improvements concerned with herein will be sold subject to any and all patent reservations, easements, and all taxes and utility liens, special assessments and taxes that may be due. Wells Fargo Bank, N.A., its attorneys, and the undersigned Special Master, disclaim all responsibility for, and the purchaser at the sale takes the property "as is," in its present condition, subject to the valuation of the property by the County Assessor as real or personal property, affixture of any mobile or manufactured home to the land, deactivation of title to a mobile or manufactured home on the property, if any, environmental contamination on the property, if any, and zoning violations concerning the property, if any. NOTICE IS FURTHER GIVEN that the purchaser at such sale shall take title to the above described real property subject to a one (1) month right of redemption.
