NOTICE is hereby given that on August 11, 2017, two (2) Applications were filed with the STATE ENGINEER by Miguel Mirabal, PO Box 1588, Grants, NM, 87020, c/o Domenici Law Firm, P.C., 320 Gold Avenue SW, Suite # 1000, Albuquerque, NM, 87102 as follows: Application No. SD-03007 into B-1922 POD 1 and Application No. SD-03008-A into B-1922 POD 1 for Permits to Change Point of Diversion, Place of Use from Surface to Ground Water, in the Bluewater Underground Water Basin, State of New Mexico. The Applications will be considered and acted upon separately. (1) Under Application No. SD-03007 into B-1922 POD 1 the applicant propose to discontinue the Farm Delivery Requirement (FDR) of up to 658 acre-feet of surface water per annum (AFA), inclusive of a Crop Irrigation Requirement (CIR) of 460 AFA, from the Ojo Del Galle Spring with a point of diversion Latitude = 35.12219 N and Longitude = -107.87571 E, WGS84, also located in the SENWSE of Section 03, Township 10 North, Range 10 East, NMPM, for the irrigation of 280 acres, a portion of the 405 acres of land owned by Miguel Mirabal described as a portion of the EE Section 01, Township 10 North, Range 10 East (130 acres), a portion of Section 02, Township 10 North, Range 10 East (160 acres) and a portion of Section 03, Township 10 North, Range 10 East (115 acres). The move-from land is generally located 1.0 mile northeast of the town of San Rafeal east of State Highway 53, within Cibola County, New Mexico. (2) Under Application No. SD-03008-A into B-1922 POD 1 the applicant propose to discontinue the diversion of up to 658 acre-feet of surface water per annum (AFA), inclusive of a consumptive use of 460 AFA, from the Ojo Del Galle Spring with a point of diversion described above, for the irrigation of 280 acres, a portion of the 640 acres of land owned by Miguel Mirabal described as a portion of Section 12, Township 10 North, Range 10 East (480 acres). The move-from land is generally located 1.0 mile northeast of the town of San Rafeal east of State Highway 53, within Cibola County, New Mexico. The applicant further proposes to transfer up to a maximum amount of 685 acre-feet per annum of FDR, inclusive of 460 AFA of CIR from a portion of the water rights described in Declaration nos. SD-03007 & SD-03008-A, into undrilled well B-1922 POD 1, to be drilled to an approximate depth of 300 feet with a 14 inch casing, for the irrigation of 280 acres of land owned by Miguel Mirabal, described as a portion of Section 21, Township 10 North, Range 10 East, NMPM. The move-to land is generally located 1.5 miles southwest of the town of San Rafeal west of State Highway 53, within Cibola County, New Mexico. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, within ten (10) days after the date of the last publication of this Notice. Facsimiles (faxes) will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
