SOFIA G. MOYA AND THE UNKNOWN SPOUSE OF SOFIA G. MOYA, IF ANY, Defendants. NOTICE OF SPECIAL MASTER'S SALE NOTICE IS HEREBY GIVEN that on September 30, 2016, at the hour of 9:00 a.m. the undersigned Special Master, or her designee, will, on the front steps of the Second Judicial District Courthouse, 400 Lomas Blvd. NW, Albuquerque, New Mexico 87102, sell and convey all of the rights, title and interest of the above-named Defendants, in and to the hereinafter described real estate to the highest bidder for cash in lawful currency of the United States of America. The sale may be postponed and rescheduled at the discretion of the Special Master. The property to be sold is located at 5016 Glendale Road NW, Albuquerque, New Mexico 87105 (if there is a conflict between the legal description and the street address, the legal description shall control), and is more particularly described as follows: Lot numbered Eight-B (8-B) of Replat of Lots 8 and 9 of Glendale Gardens, a subdivision to the City of Albuquerque, New Mexico, on May 2, 1945, as the same is shown and designated on said Replat, filed in the office of the County Clerk of Bernalillo County, New Mexico on August 29, 1963 including any improvements, fixtures, and attachments. The property will be sold "as is," without warranties, express or implied, subject to all taxes, utility liens and other restrictions and easements of record, and subject to a one (1) month right of redemption by the Defendants upon entry of an order approving sale. The foregoing sale will be made to satisfy a judgment in favor of the Plaintiff, PNC Bank, National Association, rendered by the Court in the above-titled and numbered cause on January 19, 2016, being an action to foreclose a mortgage on the above- described property. The judgment in favor of the Plaintiff is $112,163.64, inclusive of interest at the rate of $9.70 for each day from January 19, 2016 to June 27, 2016. Interest will continue to accrue on the judgment amount at the rate of $9.70 per day, from June 28, 2016 until the date of sale.The property will be sold to the highest bidder for cash in lawful currency of the United States of America. In payment of a bid, the Special Master will accept only cash or a bank cashier's check issued by a federally chartered and insured bank or a New Mexico state chartered and federally insured bank or savings and loan association. The cash or cashier's check from the successful bidder must be received by the Special Master no later than 4:00 p.m. on the date of the Special Master's sale. Plaintiff may bid and purchase the property at the Special Master's sale, may bid all or a portion of its judgment in lieu of cash towards the purchase price and may submit its bid verbally or in writing. Proceeds of the sale will be distributed first to the Special Master to satisfy her fees, costs and expenses, and then to payment of the above-referenced judgment owing to the Plaintiff.
