AMENDED NOTICE OF SPECIAL MASTER'S SALE Notice is hereby given that the Special Master, Hannah B. Best, will on the 26th day of February 2013 at 11:00 a.m. at the front door of the Bernalillo County Courthouse, 400 Lomas Blvd. NW, Albuquerque, NM 87102, sell and convey all the right, title and interest of Defendant in and to the following described real estate situate in Bernalillo County, New Mexico: 39 Criswell, Tijeras NM 87059 TRACT NUMBERED TWENTY-ONE (21) OF THE CRISWELL TRACTS, BERNALILLO COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON NOVEMBER 2, 1956, IN PLAT BOOK C3, FOLIO 66. Such sale will be made pursuant to the Default Judgment and Decree of Foreclosure entered on the 10th day of December 2012 in the above-captioned and numbered cause, which involves an action to foreclose the Mortgage of the Plaintiff wherein Plaintiff was adjudged to have the first lien on the subject property in the amount of $135,849.67 as of November 6, 2012 plus interest thereon at the rate of 6.125% per annum until payment in full, for reasonable attorney fees on the unpaid balance, including principal and interest in the amount of $2,127.59 as of November 6, 2012 plus interest thereon at the rate of 6.125% per annum until payment in full, and for costs in the amount of $181.59 as of November 6, 2012 plus interest thereon at the rate of 6.125% per annum until payment in full for a total of $138,158.85 as of November 6, 2012 plus interest thereon at the rate of 6.125% per annum until payment in full plus late charges, additional attorney's fees, expenses, costs, and any other costs, fees, and expenses as set forth in the Note and Mortgage between the parties. Further, these sums do not include subsequent attorney's fees, if any, Court costs, interest or penalties to the date of sale, Special Master's fees, taxes and publication expenses or any other expenses incurred for the maintenance, protection, and preservation of the subject above-described property. The proceeds of the sale will be applied as follows: A. First, to all costs and expenses of foreclosure, including Special Master's fees, publication costs, recording fees, taxes and assessments which may become due, if any, and sale expenses in addition to any expenses or charges incurred by Plaintiff in protecting, preserving or maintaining the premises during the pendency of this action; B. Second, to Plaintiff in the full amount of its Judgment as described herein with interest, costs, expenses, subsequent attorney's fees, and any and all expenses, and costs, and any other costs, fees, and expenses as set forth in the Note and Mortgage between the parties. C. Third, the remaining excess, if any, received after payment of the foregoing, to Defendants as their interests may appear, subject to the Order of the District Court herein. Said sale shall be made to the highest bidder for cash, or the equivalent thereof. Plaintiff may bid at such sale and apply all or any part of its judgment to the purchase price in lieu of cash.
