NOTICE OF SPECIAL MASTER'S SALE Notice is hereby given that the Special Master, Hannah B. Best, will on the 16th day of May 2012 at 11:00 a.m. at the front door of the Sandoval County Judicial Complex, 1500 Idalia Rd., Building A, Bernalillo, NM 87004, sell and convey all the right, title and interest of Defendants in and to the following described real estate situate in Sandoval County, New Mexico: 272 Old Highway 44, Bernalillo NM 87004 A certain parcel of land situate within Section 29 T13N, R43, N.M.P.M., and being identified as a portion of Tract 111B1A, M.R.G.C.D. property Map No. 7, Sandoval County, New Mexico, and being more particularly described as follows: Beginning at the northeast corner of the parcel herein described, whence the Corner No. 1, Private Claim No. 22, (Brass Cap in place), said point being identified as the beginning corner of Block "A" of the El Valle Serano Subdivision, Sandoval County, New Mexico", on June 24, 1973, bears N. 59 deg., 06' 36" E., 774.58 feet distance; thence S. 21 deg., 48' 00" W. 113.71 feet distance to the southeast corner of the parcel herein described; thence, N. 72 deg., 31' 00" W., 73.725 feet distance to a point; thence, S. 21 deg., 48' 00" W. 197.29 feet distance to a point; being a point on the northerly right of way line of Old New Mexico State Road No. 44, thence, N. 72 deg., 31' 00" W., 20.00 feet distance along said northerly right of way line to the southwest corner of the parcel herein described; thence N. 21 deg., 48' 00" East 311.00 feet distance to the northwest corner of the parcel herein described; thence S. 72 deg., 31' 00" E., 93.725 feet distance to the place of beginning. Also shown as Parcel 3, Sierra Vista, filed in the office of the County Clerk of Sandoval County, New Mexico on June 8, 1983 in Vol. 3, folio 414B, as Document No. 35477. Such sale will be made pursuant to the Amended Stipulated and Default Judgment and Decree of Foreclosure entered on the 8th day of January 2010 in the above-captioned and numbered cause, which involves an action to foreclose the Mortgage of the Plaintiff, First Financial Credit Union, wherein Plaintiff, First Financial Credit Union, was adjudged to have the first lien on the subject property in the amount of $61,935.01 as of December 29, 2009, plus interest thereon at the rate of 6% per annum until payment in full, for reasonable attorney fees on the unpaid balance, including principal and interest in the amount of $2,500.00 as of December 29, 2009 plus interest thereon at the rate of 6% per annum until payment in full, and for costs in the amount of $326.11 as of December 29, 2009 plus interest thereon at the rate of 6% per annum until payment in full for a total of $64,761.12 as of December 29, 2009 plus interest accruing thereon at the rate of 6% per annum until payment in full plus any additional attorney's fees, expenses, and costs, and any other costs, fees, and expenses as set forth in the Adjustable Rate Note, Mortgage, Revision Agreement, and Adjustable Rate Rider between the parties. Further, these sums do not include subsequent attorney's fees, if any, Court costs, interest or penalties to the date of sale, Special Master's fees, taxes and publication expenses or any other expenses incurred for the maintenance, protection, and preservation of the subject above-described property. The proceeds of the sale will be applied as follows: A. First, to all costs and expenses of foreclosure, including Special Master's fees, publication costs, recording fees, taxes and assessments which may become due, if any, and sale expenses in addition to any expenses or charges incurred by Plaintiff, First Financial Credit Union, in protecting, preserving or maintaining the premises during the pendency of this action; B. Second, to Plaintiff, First Financial Credit Union, in the full amount of its Judgment as described herein with interest, costs, expenses, subsequent attorney's fees, and any and all expenses, and costs, and any other costs, fees, and expenses as set forth in the Adjustable Rate Note, Mortgage, Revision Agreement, and Adjustable Rate Rider between the parties. C. Third, the remaining excess, if any, received after payment of the foregoing, to Defendants as their interests may appear, subject to the Order of the District Court herein. Said sale shall be made to the highest bidder for cash, or the equivalent thereof. Plaintiff, First Financial Credit Union Credit Union, may bid at such sale and apply all or any part of its judgment to the purchase price in lieu of cash.
