The real property which is the subject of this action is located in Valencia County, New Mexico, and is more particularly described as: Tract A (Proposed Junior College site) of Unit 23 as the same is shown on the plat of "Units 7 through 23 of Enchanted Mesa, Tome Grant, Valencia County, New Mexico, August 1973" (Sheets 1-19), filed of record May 7, 1974, in Cabinet C, Drawer 9, pp. 100-118, records of the County Clerk of Valencia County, New Mexico AND Tract identified as "Park" (Block 6) as the same is shown on Sheet 1 of the plat of Unit 65 of the Rio del Oro Subdivision in the Tome Grant, Valencia County, New Mexico, filed for record October 28, 1971 in Cabinet C, Drawer 14, pp. 145-147, records of the County Clerk of Valencia County, New Mexico AND An unnumbered parcel within Unit 65 of Rio del Oro, being the 30' Utility Easement along the Southerly boundary of Unit 65 between Sundial Blvd. and De Haan Loop (Sheet 1 of 2) as said Unit 65 of Rio del Oro is shown on the plat thereof filed in the Office of the County Clerk of Valencia County, New Mexico on October 28, 1971, Cabinet C, Drawer 14, pp. 146-147 AND Lots numbered One (1) thru Sixteen (16), inclusive, in Block lettered "A", and Lots numbered One (1) thru Sixteen (16), inclusive, in Block lettered "B", and Lots numbered One (1) thru Sixteen (16), inclusive, in Block lettered "C", and Lots numbered One (1) thru Sixteen (16), inclusive, in Block lettered "D" and Lots numbered One (1) thru Sixteen (16), inclusive, in Block lettered "E", and Lots numbered One (1) thru Twenty-two (22), inclusive, in Block lettered "F", and Tracts numbered Two (2) and Three (3), of the Final Subdivision Plat of Vistoso Ranch, Valencia County, New Mexico, as the same are shown and designated on the plat of said Subdivision, filed in the Office of the County Clerk of Valencia County, New Mexico on May 11, 1998, in Plat Cabinet "J", folio 216 (hereinafter the "Subject Property"). The Complaint seeks the following relief: a declaratory judgment that none of the Defendants shall have the right to enter upon the surface of the Subject Property on the basis of any purported mineral interest associated with the Subject Property, including any purported right to develop, mine, or extract any minerals of any sort therefrom.
