NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 3863 Montgomery Blvd. NE #1523, Albuquerque, New Mexico 87109, and more particularly described as follows: UNIT K-023, HILLCREST PARK, A RESIDENTIAL CONDOMINIUM ENTERPRISE, ACCORDING TO A CONDOMINIUM DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR HILLCREST PARK, DATED NOVEMBER 27, 1979, FILED FOR RECORD ON NOVEMBER 27, 1979, IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO, NEW MEXICO, IN BOOK MISC. 735, PAGES 334-379 OF THE BERNALILLO COUNTY RECORDS TOGETHER WITH THE UNDIVIDED INTEREST IN COMMON AREAS DECLARED IN THE CONDOMINIUM DECLARATION TO BE APPURTENANT TO SUCH CONDOMINIUM UNIT. SAID HILLCREST PARK CONDOMINIUMS BEING LOCATED ON TRACT LETTERED "A" OF MONTICELLO WAY ADDITION, IN THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID ADDITION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON JANUARY 7, 1972. The sale is to begin at 2:15 p.m. on May 2, 2012, outside the front entrance to the Bernalillo County Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted BOKF, N.A. BOKF, N.A. was awarded a Judgment on March 26, 2012, in the principal sum of $51,758.58, plus outstanding interest due on the Note through March 1, 2012, in the amount of $2,620.26 and accruing thereafter at the rate of $9.57 per diem, plus late charges of $69.00, plus escrow advances of $1,356.51, plus a fee advance of $700.00, plus reasonable attorney's fees incurred by Plaintiff through March 1, 2012, in the sum of $950.00, and costs through March 1, 2012, in the sum of $721.41, with interest on the aforesaid amounts at the rate of 6.750% per annum from date of the entry of this Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of the Defendant as specified in the Judgment filed herein.
