NOTICE OF FORECLOSURE SALE Notice is hereby given that on May 3, 2012, commencing at 9:00 a.m., in front of the Bernalillo County Courthouse, Bernalillo County Courthouse, 400 Lomas NW., Albuquerque, New Mexico, pursuant to a Final Judgment and Decree of Foreclosure, entered on March 21, 2012, in the above-entitled cause (the "Judgment"), the Special Master, or his designee, will offer for sale and will sell, to the highest bidder, real property in Bernalillo County, more particularly described as: Lot numbered Four-A (4-A), in Block lettered "C", of JOHN M. MOORE REALTY COMPANY'S ADDITION NO. 3, together with the Easterly 10' vacated alley, Town of Albuquerque Grant, Projected Section 18, T.10N., R.3E., N.M.P.M., Albuquerque, Bernalillo County, New Mexico, as the same is shown and designated on the plat of said Subdivision, filed in the office of the County Clerk of Bernalillo County, New Mexico, on March 28, 2006, in Plat Book 2006C, folio 99, as Document No. 2006043331, commonly known as 617 Main Street NW, Albuquerque, New Mexico, and any improvements thereon (the "Property"). Pursuant to the Judgment, the Court foreclosed a first mortgage, owned by LPP Mortgage, Ltd. ("LPP") on the Property, and awarded a judgment in favor of LPP and against defendant Justin Harper Simmons in the total amount $429,881.49 (the "Judgment Amount"), plus interest accruing after March 21, 2012 at the rate of 8.75% per annum. The Court further ordered that LPP is allowed to credit bid any portion of the Judgment Amount on the Property, in LPP's sole discretion. The sale of the Property will be for cash or cash equivalents, payable immediately. LPP may submit to the Special Master written credit bids prior to the sale. The Special Master is authorized to postpone the sale from time to time without further notice or publication, in his discretion. Notice is further given that the purchaser at the foreclosure sale shall take title to the Property subject to a one-month right of redemption; any existing and prior patents, reservations, restrictions, easements, rights-of-way, and other such matters of record, if any; and accrued and unpaid ad valorem taxes, if any, owed on the Property.
