NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 9008 Shoshone Road NE, Albuquerque, New Mexico 87111, and more particularly described as follows: LOT NUMBERED SEVEN (7) IN BLOCK NUMBERED TWO (2) OF NASSIF GARDENS, A SUBDIVISION TO THE CITY OF ALBUQUERQUE, NEW MEXICO AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID SUBDIVISION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON MAY 5, 1953, IN PLAT BOOK D1, PAGE 89. The sale is to begin at 2:10 p.m. on May 2, 2012, outside the front entrance to the Bernalillo County Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted BOKF, N.A. BOKF, N.A. was awarded a Judgment on March 23, 2012, in the principal sum of $168,967.17, plus outstanding interest due on the Note through January 1, 2012, in the amount of $4,329.78, and accruing thereafter at the rate of 5.1250% per annum ($23.72 per diem), plus late charges in the amount of $195.20, plus escrow advances in the amount of $404.42, plus fee and cost advances in the amount of $730.00, plus reasonable attorney's fees incurred by Plaintiff through January 1, 2012, in the sum of $950.00, plus costs incurred by Plaintiff through January 1, 2012, in the sum of $273.91, with interest on the aforesaid amounts from date of Judgment until paid at the rate of 5.125% per annum. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of the Defendants as specified in the Judgment filed herein.
