NOTICE is hereby given that on November 29, 2011, and March 30, 2012, the Center for Educational Initiative, 3426 Blake Road S.W., Albuquerque, NM 87105, and Buena Vista, 931 San Pedro S.E., Albuquerque, NM 87108, both c/o Nick Cortese, as co-applicants filed Application No. SD-07396-Amended-B into RG 93238 and RG-93239 with the STATE ENGINEER for Permit to Change Point of Diversion and Purpose and Place of Use within the Rio Grande Water Basin. The applicants propose to discontinue the diversion of 4.29 acre-feet per annum (afa) of water with a consumptive use of 3 afa from the Newborn Ditch with a point of diversion on the Rio Grande at the Angostura Diversion Dam located at a point where X=363,856 meters, and Y=3,916,198 meters, NAD83, Zone 13N, in the SW1/4 SE1/4 SE1/4, Section 8, Township 13 North, Range 4 East, NMPM, Sandoval County, and from well RG-91219 POD1 (supplemental to surface water), located at a point where X-343,916 meters and Y=3,878,254 meters, UTM, Zone 13, NAD83, used for irrigation purposes on 1.43 acres of land located in the southeast comer of Tract A-2, of Plat of Tracts A-l & A- 2, South Valley Academy, MRGCD Map 46, in Section 2, Township 9 North, Range 3 East, NMPM. The 1.43 acres of move from land is owned by the Center for Educational Initiatives, generally located south of Blake Rd., SW, in between Arenal Main Canal and the Isleta Interior Drain, South Valley, Albuquerque, Bernalillo County. The move to land and wells are owned by Buena Vista, LLC, generally located approximately 2.5 miles southeast of the 1-25 Waldo Exit on the road to Waldo, "La Bajada Hill", Santa Fe County. Any person or entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) be detrimental to the objector's water right; or (2) be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that they show how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible, signed, and include the complete mailing address of the objector. An objection or protest must be filed with the state engineer not later than 10 calendar days after the date of the last publication of this notice. An objection or protest may be mailed to the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109-4127 or faxed to (505) 383-4030 provided the original is hand-delivered or postmarked within 24 hours after transmission of the fax. The State Engineer will take the application up for consideration in the most appropriate and timely manner practical.
