NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me as Special Master in this matter with the power to sell, has ordered me to sell the real and personal property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 1600 Kentucky Street, NE, Albuquerque, NM, 87110, and more particularly described as follows: LOT NUMBERED ONE (1), IN BLOCK NUMBERED TWENTY-FIVE (25), OF FREDERICK A. FARR ADDITION, CITY OF ALBUQUERQUE, NEW MEXICO, AS THE THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID SUBDVISION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON OCTOBER 16, 1947, IN PLAT BOCK C, FOLIO 74. The sale is to begin at 12:00 p.m. (Noon) on January 14, 2009, outside the front entrance to the Bernalillo County Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash, in lawful currency of the United States of America, the Property to pay expenses of sale and to satisfy the Judgment granted HSBC Bank USA, N.A. HSBC Bank USA, N.A., was awarded a Judgment on December 4, 2008, in the principal sum of $223,168.72, plus outstanding interest through July 15, 2008, in the amount of $11,855.85 and accruing daily thereafter at a rate of $52.69 per day, plus late charges of $316.16, plus fees and expenses in the amount of $504.92, plus an escrow advanced balance in the amount of $525.87, minus a suspense balance in the amount of $84.26, plus attorneys' fees incurred by Plaintiff in this action in the sum of $750.00 and costs through July 15, 2008, in the sum of $2,045.28, with interest on the late charges, property preservation fees, attorney's fees and costs of this suit at the rate of 5.00% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of Defendant(s) as specified in the Judgment filed herein.
