FIRST AMENDED NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me as Special Master in this matter with the power to sell, has ordered me to sell the real and personal property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 522 Ponderosa Avenue, NW, Albuquerque, New Mexico, 87107, and more particularly described as follows: LOT NUMBERED FOURTEEN (14) IN BLOCK NUMBERED TWELVE (12) OF SANDIA PLAZA, A SUBDIVISION OF A TRACT OF LAND IN SCHOOL DISTRICT NO. 22, CITY OF ALBUQUERQUE, BERNALILLO COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON AUGUST 28, 1941. The sale is to begin at 12:00 p.m. (Noon) on February 25, 2009, outside the front entrance to the Bernalillo County Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash, in lawful currency of the United States of America, the Property to pay expenses of sale and to satisfy the Judgment granted GMAC Mortgage, LLC. GMAC Mortgage, LLC, was awarded a Judgment on October 8, 2008, in the principal sum of $98,373.03, plus outstanding interest through September 25, 2008, in the amount of $3,542.99, and accruing daily thereafter at a rate of $17.18 per day, plus property inspection fees in the amount of $56.25, plus late charges in the amount of $249.52, plus escrow advances in the amount of $345.95, plus expense advances in the amount of $84.48, plus speedpay fee in the amount of $7.50, minus unapplied funds in the amount of $208.54, plus attorneys' fees incurred by Plaintiff in this action in the sum of $900.00 and costs in the sum of $473.92, with interest on the late charges, property preservation fees, attorney's fees and costs of this suit at the rate of 5.00% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of Defendant(s) as specified in the Judgment filed herein.
