NOTICE is hereby given that on October 2, 2008, the City of Rio Rancho ("City"), c/o Lisa Vornholt, 3200 Civic Center Circle NE, Rio Rancho, NM 87144, along with Pete D. Cordova and Theresa B. Cordova, P.O. Box 276, Los Lunas, NM 87031, filed as co-applicants, Application No. SD-08156 into RG-6745 et al., with companion Application No. (RG-6745 et al. into SD-08156)-T, and Application No. SD-03824-A into RG-6745 et al., with companion Application No. (RG-6745 et al. into SD-03824-A)-T, with the STATE ENGINEER for Permits to Change Point of Diversion, Place and Purpose of Use from Surface to Ground Water, and companion permits for Temporary Transfer, within the Rio Grande Underground Water Basin. Under Application Nos. SD-08156 into RG-6745 et al., and SD-03824-A into RG-6745 et al. the applicants propose to discontinue the combined diversion amount of 78.6141 acre feet of surface water per annum, inclusive of a consumptive irrigation requirement of 55.0298 acre-feet per annum ("afa"), from the Los Lentes Ditch, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3) of the MRGCD, located at a point where X=369,686.4 feet and Y=1,421,189 feet, NMCS, Central Zone, NAD 1927, Isleta Pueblo Grant, also located in the NE1/4 NE1/4 SW1/4 of Section 24, Township 8 North, Range 2 East, NMPM, used for irrigation of the 26.2047 acres of land, owned by Pete Cordova, as described under SD-08156 as appurtenant to Tract 68 (1.5307 acres) and Tract 65B1 (0.92 acre); and part of SD-03824 as appurtenant to Tract 39A1B (0.7346 acres), Tract 63B (1.4394 acres), Tract 64B (1.37 acres), Tract 3 (12.1898 acres), Tract 66A1 (4.241 acres), Tract 66A2 (0.84 acre), Tract 69 (1.85 acres), Tract 66B (0.44 acre) and a Ditch Easement (0.65 acre), all on MRGCD Map 69, located within Section 21 and 22, Township 7 North, Range 2 East. Said 26.2047 acres of move-from land are generally located approximately 200 feet east of the intersection of Highway 85 and Tondre Road, Village of Los Lunas, Valencia County, New Mexico. The applicants further propose to transfer the above-described 55.0298 afa of consumptive irrigation requirement to the City's permitted wells under RG-6745 et al., consisting of 35 existing and proposed system production wells, all located within the city metropolitan area in Sandoval County, for municipal use within the service area of the Rio Rancho municipal water system. Diversion of water under Permit RG-6745 et al. shall not exceed 24,020.16 acre-feet per annum for domestic, commercial, industrial, housing subdivision, and related purposes within the service area of the City Municipal Water System. No increase in diversion is requested by the transfer of water rights under this application. This application is made for the purpose of complying with the Conditions of Approval of Permit No. RG-6745 et al., which requires the City to offset the impacts of groundwater pumping on surface flows of the Rio Grande. Under Application Nos. (RG-6745 et al. into SD-08156)-T, and (RG-6745 et al. into SD-03824-A)-T, the applicants request that water rights be retained at their move-from location for a period of ten (10) years upon approval of the transfer by the State Engineer, to include an additional five (5) year term or longer as the parties may agree, subject to approval by the State Engineer, by reason that the water rights are not immediately needed for the exercise of Permit No. RG-6745 et al. Any person or entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) be detrimental to the objector's water right; or (2) be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that they show how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible and signed, and include the mailing address of the objector. An objection or protest must be filed with the State Engineer no later than 10 calendar days after the date of the last publication of this notice. An objection or protest may be mailed to the Office of the State Engineer, 121 Tijeras NE, Suite 2000, Albuquerque, NM 87102, or faxed to (505) 764-3892, provided that the original is hand-delivered or postmarked within 24 hours after transmission of the fax. The State Engineer will consider the application in the most appropriate and timely manner practical.
