NOTICE OF SPECIAL MASTER'S SALE NOTICE IS HEREBY GIVEN that the undersigned Special Master will, on Tuesday the 7th day of July 2009, at 10:00 a.m., on the front steps on the northwest side of the Bernalillo County Courthouse, 400 Lomas NW, Albuquerque, New Mexico, sell and convey all of the right, title and interest of the parties in the above-entitled action in and to that certain real property (the "Property") located at 3737 Alamogordo Drive NW, Bernalillo County, Albuquerque, New Mexico 87120. The Property is more particularly described as follows: LOT NUMBERED ONE-A (1-A) OF CORONA DEL SOL SUBDIVISION, CITY OF ALBUQUERQUE, BERNALILLO COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID SUBDIVISION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO ON AUGUST 10, 2006, IN PLAT BOOK 2006C, PAGE 244 together with all structures and improvements thereon The Property will be sold "as is," without warranties, express or implied. This foreclosure sale is being made pursuant to the Amended Default Judgment and Decree of Foreclosure (the "Judgment") entered in the above-entitled cause on June 2, 2009, in an action to foreclose the interests, mortgages, and liens of the parties, under which First Community Bank (the "Bank") was determined to have a first Mortgage which is prior to any liens, mortgages, or claims of interest of the other parties herein, and the redemption period was determined to be one (1) month. The lien of the Bank secure the Judgment against the rights, title, interest and claims of the Defendants and all other persons or entities bound by these proceedings in the principal sum of $720,000.00, plus interest (on the principal sum of $720,000.00) through May 19, 2009 in the amount of $29,184.98, plus interest thereafter at the rate of 6.75% per annum ($117.64 per diem) until the date of entry of judgment, plus attorney fees, tax, costs and expenses incurred herein in the amount of $3,500.00, including attorney fees, tax, costs and expenses incurred herein to complete the foreclosure, less any appropriate credits, plus interest on the entire judgment at the rate of 6.75% per annum, until paid in full. As of the date of the Special Master's sale the total amount of the Judgment of the Bank will be $759,214.44. However, said sum does not include the costs, expenses and fees of the Special Master (estimated to be approximately $250.00 plus tax, plus the cost of publication of Notice). The Property will be sold to the highest bidder for cash in lawful currency of the United States of America. In payment of a bid, the Special Master will accept only cash or a bank cashier's check issued by a federally chartered and insured bank or a New Mexico state chartered and federally insured bank or savings and loan association. The cash or cashier's check from the successful bidder must be received by the Special Master no later than 2:00 p.m. on the date of the Special Master's sale. Plaintiff, First Community Bank may bid and purchase the Property at the Special Master's sale, and may bid all or a portion of its Judgment in lieu of cash towards the purchase price. Proceeds of the sale will be distributed first to the Special Master to satisfy her fees, costs and expenses, and then to payment of the above-referenced Judgment owing to First Community Bank.
