THIRD AMENDED NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 5809 Quail Road NW, Albuquerque, NM 87120, and more particularly described as follows: LOT NUMBERED THIRTY-SIX (36) OF THE SUBDIVISION PLAT MAP FOR ESTRELLA BRILLANTE OF THE KINDRICK ADDITION, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO ON AUGUST 17, 1983 IN VOLUME C21, FOLIO 193. The sale is to begin at 12:00 noon on March 11, 2009, on the front steps of the new Bernalillo County Court House, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted to MERS. MERS was awarded a Judgment on April 13, 2007, in the principal sum of $95,469.62, plus outstanding interest through April 15, 2007, in the amount of $3,220.77 and accruing daily thereafter at a rate of $16.35 per day, plus late charges of $149.00, plus property preservation fees of $41.25, plus escrow advances of $2,973.33, plus attorneys fees through April 15, 2007, in the sum of $900.00 and costs through April 15, 2007, in the sum of $554.59, with interest on the late charges, escrow advances, property preservation fees, attorney's fees and costs of this suit at the rate of 6.250% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of Defendant(s) as specified in the Judgment filed herein.
