NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 1505 Dartmouth Drive NE, Albuquerque, NM 87106, and more particularly described as follows: LOT NUMBERED EIGHT (8) IN BLOCK NUMBERED EIGHT (8) OF MARBERRY'S SUBDIVISION OF THE W 1/2 OF BLOCK 7 AND E 1/2 OF BLOCK 8, OF HAINES TRACT ADDITION AND ADDITION TO THE CITY OF ALBUQUERQUE, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID ADDITION, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY NEW MEXICO ON MARCH 30, 1955. The sale is to begin at 12:00 noon on March 4, 2009, on the front steps of the Bernalillo County Court House, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Central Mortgage Company. Central Mortgage Company, was awarded a Judgment on January 23, 2009, in the principal sum of $261,165.64, plus outstanding interest due on the Note through January 15, 2009, in the amount of $14,269.86 and accruing thereafter at the rate of $55.45 per diem, plus fees of $644.81, plus release fees of $10.00, plus funds owed by borrower of $3,407.30, plus attorney fees in the sum of $900.00 and costs through December 15, 2008, in the sum of $463.92, with interest on the fees, release fees, funds owed by borrower, attorney's fees and costs of this suit at the rate of 7.750% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of Defendant as specified in the Judgment filed herein.
