NOTICE OF SALE NOTICE IS HEREBY GIVEN that pursuant to the Default Judgment, Decree of Foreclosure and Order of Sale entered on November 24, 2010, the undersigned Special Master will sell at public auction, for cash or certified funds, at the hour of 9:45 a.m. on January 5, 2011 at the main (Griffin Street) entrance of the Judge Steve Herrera Judicial Complex, 100 Catron Street, Santa Fe, New Mexico, the real property situated in Santa Fe County, New Mexico described as follows: Tract 1-A, as shown on plat entitled "Plat of Survey & Lot Line Adjustment for Tom Andrews & Karl Kernberger Tract 1-A & 2-A, situate in the South 1/2 of Section 24, T. 14 N, R 7 E, N.M.P.M., as Projected into the Mesita De Juana Lopez Grant...", filed in the office of the County Clerk, Santa Fe County, New Mexico on June 2, 1999, in Plat Book 415, Page 021, as Document No. 1077,054, (the "property") commonly known as 115B Waldo Mesa Road, Madrid, New Mexico (if there is any discrepancy between the property address and the legal description, the legal description shall control). The property will be sold subject to rights of redemption; easements, reservations and restrictions of record; taxes and governmental assessments; any liens or encumbrances not foreclosed in this proceeding; the valuation of the property by the County Assessor as real or personal property; affixture of any mobile or manufactured home to the land; deactivation of title to a mobile or manufactured home on the property; environmental contamination, if any; and zoning violations concerning the property, if any. No representation is made as to the validity of the rights of ingress and egress. Transfer of title to the highest bidder shall be without warranty or representation of any kind. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING. This action is a suit to foreclose mortgages secured by the real property described above. The total amount awarded by the Judgment to Los Alamos National Bank, with interest to the date of sale, is $221,259.72; plus its costs and attorney fees from November 1, 2010 through the date of sale of the property and any amounts advanced by Los Alamos National Bank to protect its interest in the property before sale, including insurance, maintenance, taxes, assessments or other expenses relating to the property. In addition, Los Alamos National Bank is entitled to attorney's fees and costs until all amounts owed on this Judgment are paid in full. The proceeds from the judicial sale will be applied first to the payment of the costs and expenses of the sale; then to the payment of the Judgment in favor of Los Alamos National Bank, including additional fees, costs and expenses as stated in the foregoing paragraph. Any excess funds shall be deposited with the Clerk of Court. Los Alamos National Bank may apply all or a portion of its judgment towards the purchase price.
