NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Santa Fe County, New Mexico, commonly known as 40 Chaparral Drive, Santa Fe, New Mexico, 87508, and more particularly described as follows: LOT NUMBERED THREE (3) OF THE CIMARRON SUBDIVISION, AS THE SAME IS SHOWN AND DESINGATED ON THE PLAT THEREOF FILED IN THE OFFICE OF THE COUNTY CLERK OF SANTA FE COUNTY, NEW MEXICO ON AUGUST 1, 1991 IN PLAT BOOK 226, PAGES 10-12 AS DOCUMENT NO. 744,919. The sale is to begin at 12:00 noon on February 24, 2009, outside the front entrance of the Edgewood Post Office located at 13 Plaza Loop, Edgewood, New Mexico, 87504-2268, County of Santa Fe, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted Residential Funding Corporation. Residential Funding Corporation was awarded a Judgment on December 18, 2008, in the principal sum of $360,000.00, plus outstanding interest through November 18, 2008, in the amount of $17,347.50, and accruing daily thereafter at a rate of $66.58 per day, plus property inspection fees in the amount of $56.25, plus late charges in the amount of $1,417.50, plus escrow advances in the amount of $2,461.56, plus expense advances in the amount of $1,066.00, plus corporate advances in the amount of $195.00, plus reasonable attorney's fees incurred by Plaintiff through November 30, 2008, in the sum of Nine Hundred and No/100 Dollars ($900.00), and costs through November 30, 2008, in the sum of Eight Hundred Seventy Five and 87/100 Dollars ($875.87), with interest on the late charges, escrow advances, property preservation fees, attorney's fees and costs of this suit at the rate of 5.0% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of Defendant(s) as specified in the Judgment filed herein.
