NOTICE OF FORECLOSURE SALE PLEASE TAKE NOTICE the above-entitled Court, having duly appointed a Special Master in this matter with the power to sell, has ordered me to sell the Real Estate situated in San Juan County, New Mexico commonly known as #12 County Road 3321, Aztec, New Mexico 87410 and more fully described as: Lot Fifty-Four (54) of VISTA HEIGHTS SUBDIVISION, San Juan County, New Mexico, as shown on the Plat of said Subdivision filed for record January 28, 1997 in Map File V-48, Book 1233, page 50, records of said County ("Real Estate"). And a 1997 Southern Energy-make, 800 -Model , 28' X 80' Manufactured Home, serial number DSETX03349AB upon such Real Estate. A Default Judgment, Decree of Foreclosure and Appointment of Special Master was entered in the above, captioned and numbered cause against the Defendants Benson on November 16, 2009. The sale is to begin at 10:00 a.m. on January 6, 2010, at the main entrance of the Eleventh Judicial District Courthouse, 851 Andrea Drive, Farmington, New Mexico, at which time I will sell to the highest bidder for cash in the lawful currency of the United States of America, the above-described Real Estate and all improvements thereon and the above-described Manufactured Home to pay the expenses of such Default Judgment, Decree of Foreclosure and Appointment of Special Master referred to above, and to satisfy the Judgment in favor of Plaintiff in the total amount of $108,230.80, including interest to the date of the Foreclosure Sale. At such sale, the Plaintiff may become the purchaser of the property being sold, or part thereof, and may apply all or part of the Judgment to the bid, should it be the highest bidder. Any purchaser at such sale must pay, in cash or an unconditional, irrevocable letter of credit issued upon a financial institution and in a form acceptable to me.
