NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 4628 Carl Hatch Place, Albuquerque, New Mexico, 87114, and more particularly described as follows: LOT NUMBERED ONE HUNDRED THIRTY-SIX (136), SECOND CORRECTED PLAT OF CONGRESS HEIGHTS, BEING A REPLAT OF TRACT 15 AND 16 EAGLE RANCH, CITY OF ALBUQUERQUE, BERNALILLO COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON SAID REPLAT FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY NEW MEXICO, ON APRIL 20, 1988, IN PLAT BOOK C36, FOLIO 87. The sale is to begin at 12:10 p.m. on January 21, 2009, on the front steps of the Bernalillo County Court House, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted GMAC Mortgage, LLC. GMAC Mortgage, LLC, was awarded a Judgment on December 18, 2008, in the principal sum of $207,926.60, plus outstanding interest due on the Note through November 5, 2008, in the amount of $9,125.92 and accruing thereafter at the rate of $37.03 per diem, plus late charges of $604.08, plus property inspection fees of $90.00, plus escrow advances of $1,449.02, plus attorney fees in the sum of $900.00 and costs through November 15, 2008, in the sum of $609.95, with interest on the late charges, property inspection fees, escrow advances, attorney's fees and costs of this suit at the rate of 6.50% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of Defendant as specified in the Judgment filed herein.
