NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me as Special Master in this matter with the power to sell, has ordered me to sell the real and personal property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 418 Mesilla Street, NE, Albuquerque, NM, 87108, and more particularly described as follows: LOT NUMBERED NINETEEN (19) AND THE NORTH TEN (10') FEET OF LOT NUMBERED TWENTY (20) IN BLOCK NUMBERED SIX (6) OP DEL NORTE, A SUBDIVISION OF A TRACT OF LAND IN SCHOOL DISTRICT 13, BERNALILLO COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON THE PLAT OF SAID SUBDIVISION FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON DECEMBER 11, 1994, IN PLAT BOOK D, FOLIO 15. The sale is to begin at 12:05 p.m. on February 25, 2009, outside the front entrance to the Bernalillo County Courthouse, City of Albuquerque, County of Bernalillo, State of New Mexico, at which time I will sell to the highest and best bidder for cash, in lawful currency of the United States of America, the Property to pay expenses of sale and to satisfy the Judgment granted Residential Funding Corporation. Residential Funding Corporation was awarded a judgment on January 8, 2009, in the principal sum of $164,480.07, plus outstanding interest due on the Note through November 14, 2008, in the amount of $7,621.58 and accruing thereafter at the rate of $33.80 per diem, plus late charges in the amount of $347.64, plus property inspection fees in the amount of $45.00, plus escrow advances in the amount of $1,043.11, plus corporate advances in the amount of $166.00, plus attorneys' fees incurred by Plaintiff in this action in the sum of $900.00 and costs in the sum of $473.92, with interest on the late charges, property preservation fees, attorney's fees and costs of this suit at the rate of 7.50% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of Defendant(s) as specified in the Judgment filed herein.
