STATE OF NEW MEXICO COUNTY OF BERNALILLO SECOND JUDICIAL DISTRICT COURT No. D-202-CV-2008-9947 HOUSEHOLD FINANCE CORPORATION, Plaintiff, vs. TANYA FORD A/K/A TANYA MARIE FORD A/K/A TANYA MARIE PERKINS, HOMER FORD A/K/A HOMER OLIVER FORD, AND RIO GRANDE CREDIT UNION, Defendants. NOTICE OF SALE Notice is hereby given that on January 8, 2009, at the hour of 10:00 am the undersigned Special Master, or her designee, will, at the front entrance of the Bernalillo County Courthouse, at 400 Lomas Blvd. NW, Albuquerque, NM 87103, sell all of the rights, title and interest of the above-named Defendants, in and to the hereinafter described real estate to the highest bidder for cash. The property to be sold is located at 3436 Alpha Ct. NW, Albuquerque, New Mexico 87120, (if there is a conflict between the legal description and the street address, the legal description shall control) and is more particularly described as follows: Lot numbered One (1) in Block numbered Five (5) of Katherine Village Addition, a subdiviaion of the City of Albuquerque, New Mexico, as the same is shown and designated on the Third Amended Plat of said subdivision, filed in the Offie of the county Clerk of Bernalillo County, New Mexico, on March 21, 1979, and the parcel of land described as follows: The westerly one-half (1/2) of the vacated North/South Alley adjacent to Lot numbered One (1) in Block numbered Five (5) of Katherine Village Addition, Albuquerque, New Mexico, as described more particularly below: Said North/South Alley vacated by Environmental Planning Commission Land Controls Board Resolution V-78-21, filed in the Office of the County Clerk of Bernalillo County on December 21, 1978, in Book MISC 658, folio 837. The Westerly one-half (1/2) of said vacated North/South Alley was conveyed to Roberson Construction Co., Inc., by The City of Albuquerque, New Mexico by Quitclaim Deed, recorded in the Office of the County Clerk of Bernalillo County, New Mexico, on March 2, 1979 in Book D85-A, on page 722. Tha City reserves the full width of the vacated alley, as an easement for public utilities, whether municipally or privately owned, which are necessary for public use and benefit at the present time or in the future. BEGINNING at the northeast corned of said Lot numbered One (1) in Block numbered Five (5) of Katherine Village, Albuquerque, New Mexico, as the same is shown and designated on the "Third Amended Plat of Katherine Village, Replat of Tract 25 and a portion of Tract 22 of Corona Del Sol Subdivision and vacated portions of Redlands Rd. and Corona Drive NW, Albuquerque, Bernalillo County, New Mexico", recorded in the Office of the County Clerk of Bernalillo County, on March 21, 1979, and running: thence, S 89 54; 00: E. 10.04' to the northeast corner o the parcel herein described: thence S 5 00' 00" W. 32.79 to the southeast corner: thence N 89 54' 00" W. 10.04' to the southwest corner: thence N 5 00' 00" E. 32.79' to the point of beginning," including any improvements, fixtures, and attachments, such as, but not limited to, mobile homes. Subject to all taxes, utility liens and other restrictions and easements of record, and subject to a one (1) month right of redemption by the Defendants upon entry of an order approving sale. The foregoing sale will be made to satisfy a foreclosure judgment rendered by this Court in the above-entitled and numbered cause on November 13, 2008, being an action to foreclose a mortgage on the above-described property. The Plaintiff's judgment is $139,561.52, and the same bears interest at the rate of 12.3800% per annum, which accrues at the rate of $47.34 per diem, commencing on November 15, 2008, with the Court reserving entry of final judgment against said Defendants Tanya Ford and Homer Ford for the amount due after foreclosure sale, for costs and attorney's fees, plus interest as may be assessed by the Court. The Plaintiff has the right to bid at such sale all of its judgment amount and submit its bid verbally or in writing. The Plaintiff may apply all or any part of its judgment to the purchase price in lieu of cash. The sale may be postponed and rescheduled at the discretion of the Special Master. The Court's decree, having duly appointed its Special Master to advertise and immediately offer for sale the subject real estate and to apply the proceeds of sale, first to the costs of sale and the Special Master's fees, then to pay the above-described judgment, interest, and costs of sale, and to pay unto the registry of the Court any balance remaining to satisfy future adjudication of priority mortgage holders; NOW, THEREFORE, notice is hereby given that in the event that said property is not sooner redeemed, the undersigned will as set forth above, offer for sale and sell to the highest bidder for cash or equivalent, the lands and improvements described above for the purpose of satisfying, in the adjudged order of priorities, the judgment described herein and decree of foreclosure together with any additional costs and attorney's fees, costs of advertisement and publication, a reasonable receiver and Special Master's fee to be fixed by the Court. The total amount of the judgment due is $139,561.52, plus interest to and including date of sale of $2,603.70 for a total judgment plus interest of $142,165.22.
