The foregoing sale will be made to satisfy an In Rem foreclosure judgment rendered by this Court in the above-entitled and numbered cause on January 27, 2020, being an action to foreclose a mortgage on the Property. NOTICE is hereby given that on December 30, 2019, Joe and Julie Samora, P.O Box 70002, Albuquerque, NM 87197, filed with the STATE ENGINEER Application No. RG-15961-A POD2, for Permit for an Additional Groundwater Point of Diversion within the Rio Grande Underground Water Basin of the State of New Mexico. Bernalillo County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Albuquerque Journal. The applicants propose to drill and commence use of an additional groundwater point of diversion (RG-15961-A POD2), completed with an outside diameter casing of 8 inches, to an approximate depth of 50 feet, located within Tract A-3, within Section 17, Township 11 North, Range 3 East, NMPM, within the Town of Alameda Grant, at a point described as approximately where 35 11' 11.94? North Latitude and 106 38' 34.58? West Longitude intersect, WGS84, on land owned by Joe and Julie Samora, for the continued permitted diversion of 3.15 acre-feet per annum inclusive of a Consumptive Use amount of 2.205 acre-feet per annum, for the irrigation of 1.05 acres, owned by Joe and Julie Samora, being Tract A-3 (part of former Tract 13-a-2), on MRGCD Map No. 25, within Section 17, Township 11 North, Range 3 East, NMPM. Said land is part of the original place of use permitted under Permit RG-15961, approved by the State Engineer on September 4, 1968, for the irrigation of a total of 3.0 acres of land being Part of the East 1/3 of Tract 13a-1 and Part of Tract 13-a-2, within Section 17, Township 11 North, Range 3 East, NMPM, and to supplement water supplied through the works of the Middle Rio Grande Conservancy District (MRGCD), with a total combined diversion of water not to exceed 3.0 acre-feet per acre per annum. Permitted Well RG-15961 was completed January 1972, within Tract 13-a-1 (now Tract A-1 per April 1987 subdivision and replat), located where 35 11' 14.49? North Latitude and 106 38' 36.84? West Longitude intersect, WGS84, on land owned by Donald Duke, on MRGCD Map No. 25, within Section 17, Township 11 North, Range 3 East, NMPM. The applicant's state an additional groundwater point of diversion (RG-15961-A POD2) is needed because the original permitted well RG-15961 is located on another tract (owned by Donald Duke) and is inaccessible. The applicants' 1.05 acres of land is presently irrigated, and will continue to be, by the works at the Middle Rio Grande Conservancy District from the Rio Grande via the Albuquerque Main Canal. Said proposed well will supplement water supplied through the works of the MRGCD. No new appropriations are requested under this application. The general location of the proposed well and the place of use is within Tract A-3, said tract is located on the south side of Duke Lane NW, at the intersection of Rio Grande Blvd. NW and Duke Lane NW, within the Village of Los Ranchos de Albuquerque, Bernalillo County, New Mexico. The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected.
