STATE OF NEW MEXICO BEFORE THE SECRETARY OF ENVIRONMENT IN THE MATTER OF THE APPLICATION OF AMERICAN EAGLE BRICK COMPANY, FOR AN AIR QUALITY CONSTRUCTION PERMIT FOR THE AMERICAN EAGLE BRICK PLANT AQCA 09-02(P) NOTICE OF PUBLIC HEARING The New Mexico Environment Department ("NMED") announces a public hearing to take evidence on an application for an air quality construction permit for American Eagle Brick Company's brick manufacturing plant pursuant to the New Mexico Air Quality Control Act, NMSA 1978, 74-2-1 et seq., and Section 206 of 20.2.72 NMAC - Construction Permits. The hearing will begin at 5:00 p.m., April 7, 2009, at the Sunland Park Elementary School in Sunland Park, New Mexico. The School is located at 305 Alto Vista Drive in Sunland Park. The hearing will be conducted in accordance with the Environment Department Permitting Procedures, 20.1.4 NMAC, the procedures in Air Quality Construction Permits, 20.2.72 NMAC, and other applicable hearing procedures. American Eagle submitted an air quality permit application to permit a 8.5 ton per hour brick manufacturing facility located at 1000 Brickland Road, approximately 2.2 miles southeast of Sunland Park City Hall, Sunland Park, New Mexico in Dona Ana County. American Eagle owns and operates the plant. American Eagle's mailing address is PO Box 12786, El Paso, Texas 79913. American Eagle filed the air quality construction permit application for the plant on March 26, 2007, and it was deemed complete on November 21, 2007. The NMED Air Quality Bureau ("AQB") has reviewed the application, including emission rates and concluded that the proposed plant will comply with applicable requirements and not cause or contribute to an exceedance of federal and state ambient air quality standards. NMED will accept non-technical written public comments regarding the proposed facility on or before April 7, 2009. Such comments may be filed in advance with the Hearing Clerk at the address below, or with the Hearing Officer at the hearing. The Hearing Officer will accept non-technical public comments at 6:30 pm, and periodically throughout the hearing, until the Hearing Officer has determined that all persons have been given a reasonable opportunity to be heard. The evidentiary record may be closed at the conclusion of the hearing. All oral testimony and public comment shall be received under oath. The Hearing Officer may set reasonable limits on oral non-technical public comments. TECHNICAL WRITTEN OR ORAL TESTIMONY Any person, including the Applicant, who wishes to present technical testimony at the hearing must file a Statement of Intent to Present Technical Testimony on or before March 24, 2009. Length of Testimony: Estimate the length of the direct testimony of each witness; and 5.Direct Testimony: Submit a summary of the testimony each witness, stating any opinion(s) to be offered by such witness, and an explanation of the basis for such opinion(s). 6.Exhibits: Identify all exhibits to be offered by each witness. For documents not in the Administrative Record, attach a copy. 7.Technical Material: List or make available all technical materials relied upon by each witness in making a statement of technical fact or opinion. A person's failure to file a timely Statement of Intent substantially complying with these requirements shall preclude the person from presenting technical testimony. ENTRY OF APPEARANCE Any person who wishes to be a party in this proceeding must file with the Hearing Clerk at the above address a Statement of Intent or an Entry of Appearance on or before March 24, 2009. A timely Statement of Intent to Submit Technical Testimony shall be considered an Entry of Appearance. The Entry of Appearance must contain the following information: 1.Person: Identify the person filing the entry of appearance; and 2.Position: State whether the person filing the entry of appearance supports or opposes issuance of the permit. A person's failure to file a timely Statement of Intent or Entry of Appearance substantially complying with these requirements shall preclude the person from becoming a party, but shall not preclude a person from presenting a general written or oral statement or non-technical testimony. POST-HEARING PROCESS Participation in the post-hearing process will be limited to parties. El AQB llevo a cabo un analisis de la informacin contenida en la solicitud para el permiso de construccion presentada por American Eagle. En la revision se incluyo la valoracion del modelo de dispersion y las tasas de emision y requisitos aplicables tal como American Eagle los presento en su solicitud. El analisis de la solicitud del permiso hecho por AQB y la informacion presentada por American Eagle indica que los impactos ambientales de las emisiones de las fuentes de las instalaciones en combinacion con otros impactos circundados cumplen con los estandares estatales y federales reglamentados. Ademas, identifique cualquier termino o condicion del proyecto del permiso asentado por el testigo. 6.Anexos: Los documentos que no se han presentado existan en los registros administrativos deberan adjuntarse, si la persona intenta ofrecerlos. 7.Material tecnico: Enumere o haga disponible toda materia tecnica usada por cada testigo cuando presenta informacion tecnico de hechos u opiniones. La omision de la notificacion oportuna de una declaracion para presentar un dictamen que forme parte importante de los requisitos mencionados impedira que una persona presente un dictamen tecnico. Cualquier persona, incluyendo el solicitante, que quiere participar en la audiencia debera presentar, ante el escribiente de la audiencia, una notificacion de intento para presentar un dictamen tecnico, como se describe arriba o aceptacion de presentacion hasta el 24 marzo de 2009. La Aceptacion de Presentacion debera llevar la siguiente informacion: 1.Persona: Identifique a la persona que presenta la aceptacion; y 2.Posicion: Informe si la persona que presenta la aceptacion apoya o se opone a la autorizacion del permiso.
