NOTICE is hereby given that on January 16, 2009, the City of Rio Rancho, 3200 Civic Center Circle NE, Rio Rancho, NM 87144, and Estevan Lopez and Antonio Lopez, 178 Ramon Lopez Road, Bosque, NM 87102, filed Application No. SD-08153 into RG-6745 et al. with the STATE ENGINEER for Permit to Change Point of Diversion, Place, and Purpose of Use from Surface to Ground Water in the Rio Grande Underground Water Basin of the State of New Mexico. The tract is located approximately 430 feet northeast of where the BNSF Railway bridge crosses the Rio Puerco on the east side of Interstate Highway 25 near Bernardo, Socorro County, New Mexico. The applicants further propose to transfer the above-described 19.45 acre-feet as consumptive use to vested and permitted wells under Permit RG-6745 et al., consisting of 35 system production wells, all located within the Rio Rancho metropolitan area within Sandoval County, for municipal and related purposes within the service area of the Rio Rancho municipal water system. The diversion of water under Permit RG-6745 et al. shall not exceed 24,020.16 acre-feet per annum for domestic, commercial, industrial, housing subdivision, and related purposes within the service area of the Rio Rancho Municipal Water System. No increase in diversion is contemplated by the transfer of water rights under this application to the water system. This application is made for the purpose of complying with the Conditions of Approval of Permit RG-6745 et al., which require the City to offset the impacts of groundwater pumping on the surface flows of the Rio Grande and its tributaries. The applicant further proposes to allow the landowners, Estevan Lopez and Antonio Lopez, to exercise the water rights proposed for transfer under Application No. SD-08153 into RG-6745 et al. for a period of ten years after approval by the State Engineer and for an additional five years or longer or a term as the parties may agree upon and per the terms of the Water Rights Purchase Agreement between the Lopezes and the City of Rio Rancho. The applicant states that the reason for the temporary transfer is that it does not require the water rights for the period of the temporary transfer. Any person or other entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) Be detrimental to the objector's water right; or (2) Be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that the objector shows how they will be substantially and specifically affected by the granting of the application. A valid objection or protest shall set forth the grounds for asserting standing and shall be legible, signed, and include the complete mailing address of the objector. An objection or protest must be filed with the state engineer not later than 10 calendar days after the date of the last publication of this notice.
